[00:00:01]
GOOD EVENING, LADIES AND GENTLEMEN.
WE APPRECIATE EVERYBODY COMING TONIGHT.
TODAY IS TUESDAY, APRIL THE FIRST OF 2025.
IT'S NOT A JOKE THAT WE'RE ALL HERE, BUT, UH, HAPPY APRIL FOOLS.
HOPE EVERYBODY'S HAVING A GOOD DAY.
SO, UM, WE'RE GONNA CALL THE MEETING TO ORDER AT FIVE 30.
[2. CONFLICT OF INTEREST ]
ON THE AGENDA IS A CONFLICT OF INTEREST COMMISSIONERS.THIS IS YOUR OPPORTUNITY TO LET IT BE KNOWN IF YOU HAVE A CONFLICT OF INTEREST ON ANY OF THE ACTION ITEMS ON THE AGENDA TONIGHT.
I SEE EVERYBODY'S SHAKING THEIR HEADS NO.
SO THERE ARE NO CONFLICT OF INTEREST, WHICH IS GOOD.
UM, SO TONIGHT WE, OBVIOUSLY THERE IS WHAT, FIVE OF, OF US HERE? SO, UM, WELL, IF WE, THERE IS A TIE BREAKER TONIGHT, UM, THEN I WILL BREAK THE TIE BREAKER.
SO YOU NEED AT LEAST THREE TO ONE TO PASS TONIGHT.
OR IF THERE IS A TIE BREAKER, I'LL BREAK THAT TIE BREAKER TONIGHT.
UM, THIRD ON THE AGENDA IS THE PUBLIC COMMENTS.
UM, THIS IS AN OPPORTUNITY FOR VISITORS, GUESTS TO ADDRESS THIS WORK.
CLAIM MARK COMMISSION ON ANY ISSUES.
THE HISTORIC LANDMARK COMMISSION MAY NOT, UH, DISCUSS ANYTHING YOU MAY WISH TO DISCUSS WITH US.
NO ACTION ITEMS CAN HAPPEN AT THIS TIME ACCORDING TO ATTORNEY GENERAL.
SO IF THERE'S ANYBODY THAT WANTS TO ACTUALLY ADDRESS THE HISTORIC LANDMARK COMMISSION, THIS IS, UH, YOUR TIME TO DO THAT.
BUT IF YOU DO HAVE AN, IF YOU'RE HERE FOR AN ACTUAL ACTION ITEM TONIGHT, UM, YOU CAN WAIT UNTIL THAT GETS, UH, PRESENTED.
UM, SO IF ANYBODY WANTS TO COME UP AND TALK ABOUT ANYTHING GOING ON IN THE COMMUNITY, UM, THIS IS YOUR OPPORTUNITY SEEING NO MOVEMENT.
SO I'M GONNA GUESS EVERYBODY'S HERE FOR AN ACTUAL ACTION ITEM, WHICH IS AWESOME.
[4. CONSENT AGENDA: All items listed below within the Consent Agenda are considered routine by the Historic Landmark Commission and may be enacted with one motion. There will be no separate discussion of items unless a Commission Member or citizen so requests, in which event the item may be moved to the general order of business and considered in its normal sequence.]
THE FOURTH ITEM ON THE AGENDA IS A CONSENT AGENDA.UM, ALL ITEMS, UM, ON THE CONSENT AGENDA ARE LISTED ON THE AGENDA.
THE ONLY ITEM ON THE CONSENT AGENDA TONIGHT IS THE ACTUAL MEETING MINUTES FROM, UM, THE MONTH OF MARCH.
UM, SO MARCH THE FOURTH, 2025.
UM, THE COMMISSIONERS WISH TO DISCUSS THE CONSENT AGENDA.
IF NOT, THEN I LOOK FOR A MOTION TO APPROVE THE CONSENT AGENDA.
MR. CHAIRMAN, I MAKE THE MOTION TO APPROVE ACTION ITEM 2 0 2 5 DASH 1 3 2, THE APPROVAL OF THE MINUTES OF THE LAST MEETING, MARCH 4TH, 2025.
ALRIGHT, WE DO HAVE A FIRST AND A SECOND FOR THE APPROVAL OF THE CONSENT AGENDA OPPORTUNITY FOR EVERYBODY TO VOTE ON THAT.
[5.A. Consider a request for a demolition permit for the structure(s) located at 308 West San Antonio Avenue.]
ZERO.WE'LL MOVE ON TO, UH, THE ACTUAL ACTION ITEMS TONIGHT.
UH, THE FIRST TWO ACTION ITEMS WE DO HAVE ON THE AGENDA ARE, UM, WE'LL HAVE A COUPLE OF DIFFERENT STEPS HERE.
WE'LL HAVE A STAFF PRESENTATION, UM, THEN WE WILL OPEN IT UP FOR A PUBLIC COMMENTS, AND THEN WE WILL CLOSE THAT PORTION AND THEN OPEN IT BACK UP FOR THE ACTUAL COMMISSIONERS TO DISCUSS WITH, UM, STAFF OR THE, UM, AGENDA, UM, ON, ON THERE.
UM, SO ONCE YOU KNOW, WE HAVE THE OPPORTUNITY THEN AN OFFICER, THEN WE'LL GET TO VOTE ON THAT ACTUAL ACTION ITEM.
SO FIRST ON THE, UM, CA ON THE ACTUAL AGENDA IS, UM, FIVE A 2 0 2 5 DASH 1 3 3.
THIS IS A CONSIDERATION FOR REQUEST FOR DEMOLITION PERMIT FOR STRUCTURES LOCATED AT 3 0 8 WEST SAN ANTONIO AVENUE.
GOOD EVENING, AND THANK YOU MR. CHAIR.
UM, SO WE DO HAVE THIS EVENING TWO DEMOLITION REQUESTS ON THE AGENDA FOR, UM, PROPERTIES AND STRUCTURES THAT ARE OLDER THAN 50 YEARS.
UM, BEFORE WE DIVE INTO THE, AND THIS FIRST REQUEST, UM, AGENDA ITEM FIVE A, I THOUGHT IT WOULD BE HELPFUL TO JUST CONSIDER THE DEMOLITION REVIEW PROCESS FOR HISTORIC STRUCTURES AS OUTLINED IN SECTION TWO POINT 11 OF OUR UDC.
WE DO HAVE, UM, QUITE A FEW, UH, NEW FACES HERE THIS EVENING.
AND SO IT MAY BE THE FIRST TIME THAT SOME OF THE ATTENDEES, UM, ARE ACTUALLY EXPOSED TO THE CITY OF BERNESE PROCESSES WHEN REVIEWING DEMOLITION PERMITS FOR, UM, BUILDINGS LOCATED WITHIN CITY OF BERNIE LIMITS THAT ARE OLDER THAN 50 YEARS.
SO, UM, THE PURPOSE OF OUR DEMOLITION REVIEW PROCESS IS ULTIMATELY TO PREVENT AND MINIMIZE DAMAGE TO THE QUALITY AND CHARACTER OF THE CITY'S HISTORIC RESOURCES BY REQUIRING THE REVIEW OF STRUCTURES THAT ARE OLDER THAN 50 YEARS, AS I MENTIONED, WITHIN CITY LIMITS.
AND THE GOAL OF THE PROCESS IS TO ENABLE A DETERMINATION OF A STRUCTURE'S HISTORIC SIGNIFICANCE, UM, AND TO PROVIDE THE PUBLIC OR OTHER PRESERVATION BASED ORGANIZATIONS AND CITY STAFF AN OPPORTUNITY TO WORK WITH THE PROPERTY OWNER ON ALTERNATIVE SOLUTIONS TO DEMO DEMOLITION WHERE POSSIBLE AND WHERE APPROPRIATE.
SO AS PART OF THE DEMOLITION REVIEW PROCESS, THE CITY MUST FIRST
[00:05:01]
VERIFY THE APPLICATION FOR COMPLETENESS, VERIFY IF THE STRUCTURE IS IN FACT WITHIN CITY LIMITS, AND ALSO VERIFY IF THE STRUCTURE IS A RECORDED OR REGISTERED HISTORIC LANDMARK.FOLLOWING THESE STEPS, THE CITY MUST NOTIFY THE PUBLIC OF THE DEMOLITION REQUEST, AND THAT HAS TO BE AT LEAST 15 DAYS PRIOR TO THE CONSIDERATION OF THE DEMOLITION RE REQUEST BY THE HISTORIC LANDMARK COMMISSION.
AND THIS INCLUDES A MAILING OF THE NOTICE OF THE DEMOLITION REQUEST AND PUBLIC HEARING, UH, WITH REQUEST FOR COMMENT TO PROPERTY OWNERS LOCATED WITHIN 200 FEET OF THE PROPERTY.
AND SO, AGAIN, I, UM, CAN ATTRIBUTE PERHAPS SOME OF THE, SOME OF THE INTEREST THIS EVENING TO THAT PUBLIC HEARING NOTIFICATION PROCESS.
UM, AS PART OF THE PROCESS, WE ALSO DO A NEWSPAPER NOTICE OF THE DEMOLITION REQUEST WITH THE PUBLIC HEARING DATE, LOCATION, AND TIME.
AND THIS IS ALL TO ENCOURAGE MEMBERS OF THE PUBLIC AND CONCERNED CITIZENS TO, UM, COME FORTH AND SHARE ANY INFORMATION THAT THEY MAY HAVE REGARDING THE HISTORICAL SIGNIFICANCE OF THE PROPERTIES THAT ARE AT THE CENTER OF THE DEMOLITION REQUEST.
UM, SO ONCE WE DO ALL THAT, THEN THE HISTORIC HISTORIC LANDMARK COMMISSION HOLDS A PUBLIC HEARING LIKE WE WILL DO THIS EVENING, TO DE DETERMINE THE STRUCTURE'S HISTORIC SIGNIFICANCE AND CONSIDERING THE FOLLOWING CRITERIA.
SO CONSIDERING THE CHARACTER, UM, INTEREST OR VALUE AS PART OF THE DEVELOPMENT HERITAGE OR CULTURAL C CHARACTERISTICS OF THE CITY OF BURN, THE LOCATION OF THE SITE AS SIGNIFICANT FOR A HISTORICAL EVENT, THE EMBODIMENT OF DISTINGUISHING ARCHITECTURAL CHARACTERISTICS, THE RELATIONSHIP OF THE BUILDING OR SITE THAT IS HISTORICALLY SIGNIFICANT, UM, IN RELATION TO OTHER, UH, STRUCTURES THAT HAVE BEEN IDENTIFIED FOR PRESERVATION AND ANY UNIQUE, UH, PHYSICAL CHARACTERISTICS THAT REPRESENT, UM, A SINGULAR DISTINGUISHING VISUAL FEATURE IN A NEIGHBORHOOD COMMUNITY OR THE CITY.
SO REALLY LIKE THAT LANDMARK THAT PEOPLE THINK OF WHEN THEY ASSOCIATE, UM, A HISTORIC PLACE WITH THE CITY.
UM, OTHER ASPECTS TO CONSIDER ARE THE VALUE OF THE PROPERTY AS AN ASPECT OF COMMUNITY SENTIMENT OR PUBLIC PRIDE AND THE IDENTIFICATION OF THAT PARTICULAR STRUCTURE WITH A PERSON OR PERSONS WHO SIGNIFICANTLY CONTRIBUTED TO THE DEVELOPMENT OR CULTURE OF THE CITY.
AND SO THESE ARE OUR GUIDELINES WHEN REVIEWING THESE REQUESTS TONIGHT.
UM, SO WITH THAT BEING SAID, LET'S GET DOWN TO IT.
LET'S GET DOWN TO THE FIRST REQUEST.
SO THE FIRST ITEM THAT WE HAVE ON THE AGENDA IS, UM, A REQUEST FOR DEMOLITION OF SIX OUT OF AGE STRUCTURES, UM, LOCATED AT 3 0 8 WEST SAN ANTONIO.
THE APPLICANT WHO IS WITH US THIS EVENING IS MS. LISA BLANK.
UH, AND SHE'S ACTING ON BEHALF OF THE BEEF DORIS MARITAL TRUST.
AND, UM, THE, THE PROPERTY THAT'S AT THE CENTER OF THE DEMOLITION REQUEST IS OUTSIDE OF THE, THE HISTORIC DISTRICT, BUT IS OLDER THAN 50 YEARS.
AND THE PROPERTY IS ALSO IN THE IRONS IN GRAHAM SUBDIVISION, WHICH, UM, WE MAY HAVE SEEN THIS PLAT BEFORE, BUT THIS IS THE ORIGINAL PLAT FOR THAT SUBDIVISION FROM 1887.
SO, UM, DEFINITELY SOME, SOME OLDER PROPERTIES IN THIS NEIGHBORHOOD.
UH, WE SEE HERE A THE PRIMARY STRUCTURE, AS I MENTIONED, THERE'S EIGHT DIFFERENT STRUCTURES, UH, LOCATED AT 3 0 8 WEST SAN ANTONIO.
IT WAS BUILT IN 1952, SO MUCH LATER THAN THE ORIGINAL PLATING OF THIS PROPERTY.
WE COULD CONSIDER THAT PERHAPS THERE WAS ANOTHER ORIGINAL STRUCTURE THAT WAS ON SITE THAT GOT DEMOLISHED, UM, BEFORE THIS ONE WAS BUILT.
BUT, UH, WE CAN'T BE CERTAIN OF THAT.
BUT THIS STRUCTURE THAT WE SEE HERE IS BUILT IN THE BUNGALOW STYLE.
UM, AND IT PREVIOUSLY BELONGED TO MISS VIOLA WILSON, WHO WAS A FIRST GRADE SCHOOL TEACHER, UM, WHOSE CAREER IN BERNIE SPANNED OVER 40 YEARS.
AND, UH, THE VIOLA WILSON ELEMENTARY SCHOOL IN BERNIE, IST IS NAMED IN HER HONOR.
AND, UM, MS. BLANK IS A GRAND NIECE OF, UM, OF MS. VIOLA WILSON'S SO HAPPY THAT SHE COULD BE WITH US HERE THIS EVENING.
[00:10:01]
IS A SITE PLAN OF THE DIFFERENT, UM, STRUCTURES THAT ARE LO LOCATED ON THE PROPERTY.UM, THE HISTORIC LANDMARK COMMISSION DID HAVE AN OPPORTUNITY TO GO AND DO A SITE VISIT, UH, BACK IN MARCH.
AND SO WE'LL SEE SOME PICTURES, UM, FROM THAT SITE VISIT TO KIND OF GIVE US AN IDEA OF THE, UM, HISTORICAL, UH, ELEMENTS AND, UM, OVERALL CONDITION OF THE PROPERTY.
AND SO WHAT WE HAVE IS THAT BUNGALOW STRUCTURE BUILT IN 1952.
UM, WE DO SEE THAT THE BLUE, UH, SHINGLE STYLE SIDING IS WEATHERED AND, UM, DAMAGED IN, IN VARIOUS LOCATIONS ALONG THE FRONT FACADE.
AND THEN ALSO ALONG THE SIDE, UM, SIDE ELEVATIONS OF THE PROPERTY.
UM, WE SEE A BRIGHT ORANGE DOOR, WHICH WE CAN SAFELY DETERMINE IS NOT ORIGINAL TO THE STRUCTURE.
UM, SOME OF THE CASEMENT WINDOWS ON THE, ON THE PROPERTY OR ON THE STRUCTURE ARE APPEAR TO BE ORIGINAL TO THE, TO THE STRUCTURE, WHEREAS, UH, THE WINDOWS THAT ARE LOCATED TO THE REAR OF THE STRUCTURE, UM, AS WELL AS THE SOUTHWEST SIDE OF THE STRUCTURE APPEAR TO BE FROM A LATER TIME, SO BUILT AFTER OR ADDED TO THE STRUCTURE AFTER 1952.
SO, AS WE KNOW FROM PREVIOUS, UM, REVIEWS OF HISTORIC STRUCTURES, WHENEVER THERE ARE, YOU KNOW, MODIFICATIONS TO THE DOORS AND THE WINDOWS OF, OF, OF A BUILDING, IT DOES COMPROMISE THE, UH, HISTORICAL INTEGRITY OF AND ARCHITECTURAL INTEGRITY OF THAT STRUCTURE.
NEXT WE HAVE A, UH, WORKSHOP AND AN OPEN AIR SHED, UM, DEMOLITION IS REQUESTED FOR THESE TWO STRUCTURES IN ADDITION TO DEMOLITION OF THE PRIMARY STRUCTURE THAT WE JUST LOOKED AT.
AND, UM, THESE DO SHOW QUITE A BIT OF EVIDENCE OF WEATHERING AND, UM, DEGRADATION, ESPECIALLY IN THE CASE OF THE OPEN AIR SHED.
UH, NEXT ON THE LIST WE HAVE, UM, SOME ANOTHER SHED STYLE BUILDING, WHICH IS, UH, APPEARS TO BE A TYPE OF CORRUGATED METAL, UM, UH, ROOF AND, UH, SIDING THE WELL HOUSE.
UM, WELL THE, THE DEMOLITION IS REQUESTED FOR THAT, UH, FOURTH STRUCTURE THE SHED, WHAT WE SEE ON THE RIGHT SIDE OF THE SLIDE HERE, THE WELL HOUSE, UH, WHICH HAS THE LIMESTONE, UH, UH, CLADDING THAT IS AN EXCELLENT COLI CONDITION AND IS CURRENTLY STILL IN USE FOR THE PROPERTY.
AND SO NO DEMOLITION IS REQUESTED FOR THAT STRUCTURE.
NEXT WE HAVE, UM, A SIXTH STRUCTURE, AGAIN, A SHED WITH A TYPE OF, UM, WITH METAL, UH, METAL CONSTRUCTION, UH, SHOWING EVIDENCE OF WHERE DEMOLITION IS REQUESTED.
FOR THAT WE HAVE A SEVENTH SHED, UM, WHICH IS A TOUGH, UH, TOUGH SHED, A NEWER ONE, AND IS, UM, OWNED BY THE ADJACENT PROPERTY OWNER.
SO THE NEXT DOOR NEIGHBOR, AND THAT WILL BE RELOCATED.
SO NO DEMOLITION IS REQUESTED FOR THAT ONE.
AND THEN LASTLY, WE HAVE HERE, UM, THIS EIGHTH STRUCTURE, WHICH IS ALSO APPEARS TO BE A SHED, UM, WITH WHAT APPEARS TO BE A TYPE OF WOOD PARTICLE BOARD, UM, CONSTRUCTION AND A TYPE OF, UM, CORRUGATED METAL ROOF.
AND DEMOLITION IS REQUESTED FOR THIS STRUCTURE AS WELL.
AND SO TO SUMMARIZE, UM, SIX OF THE EIGHT BUILDINGS ON THE PROPERTY ARE REQUESTED FOR DEMOLITION.
UH, BILL BUILDING NUMBER ONE DOES HAVE SOME ELEMENTS OF ARCHITECTURAL AND CULTURAL VALUE.
WE, WE TALKED ABOUT, UM, THE WINDOWS, SOME OF THE ORIGINAL CASEMENT WINDOWS THAT HAVE SOME, UH, ARCHITECTURAL VALUE.
UM, THE CULTURAL VALUE BEING THAT THIS WAS THE RESIDENCE OF MS. BELA WILSON.
UM, HOWEVER, THE REMAINING STRUCTURES DO NOT APPEAR TO HAVE, UH, ARCHITECTURAL OR CULTURAL SIGNIFICANCE.
UM, AND AS, AS I MENTIONED EARLIER, TWO OF THE BUILDINGS IDENTIFIED IN THIS, UM, SITE PLAN AND, AND SITE VISIT, UH, WILL BE PRESERVED OR RELOCATED.
UM, ADDITIONAL DETAILS TO CONSIDER, AND THIS IS MORE RELATED TO PLAN TO OUR PLANNING, UM, PLANNING REQUIREMENTS, UM, FOR, FOR FENCING AND, UM, ALSO JUST PRESERVATION OF TREES WHENEVER WE'RE DISCUSSING A DEMOLITION REQUEST.
[00:15:01]
THAT IF THERE ARE MATURE TREES ON SITE, THAT THE MATURE TREES ARE PRESERVED IT WHENEVER THEY ARE HEALTHY AND NOT POSING A RISK TO THE PUBLIC.SO, UM, UH, WE, WE WOULD RECOMMEND, UM, YOU KNOW, IF, IF THE DEMOLITION REQUEST WERE TO ADVANCE, UM, THE PRESERVATION OF THE MATURE TREES AND THEN REMOVAL OF THE CHAIN LENGTH FENCE, WHICH IS, UH, PROHIBITED AS PER UDC SECTION 4.4 D.
ALSO OF, OF INTEREST I THINK TO THE HISTORIC LANDMARK COMMISSIONERS AND THOSE GATHERED HERE THIS EVENING, UM, WAS THE, UH, PUBLIC RESPONSES THAT WERE RECEIVED FOR THIS PARTICULAR PROPERTY.
UM, AT THE TIME OF POSTING OF THE AGENDA, THERE WERE TWO RESPONSES THAT HAD BEEN MAILED IN, UM, AS OF TODAY, WE HAD AN ADDITIONAL RESPONSE THAT WAS SHARED.
AND SO I WILL APPROACH THE DAAS WITH PERMISSION TO PROVIDE THE COMMISSIONERS WITH COPIES OF THE CONTENT OF THESE, UM, THESE REQUESTS FOR CONSIDERATION OF COMMENT.
AND, UM, THANK YOU, THE COURT.
SO AS MENTIONED, THREE PUBLIC RESPONSES WERE RECEIVED IN FAVOR OF DEMOLITION.
SOME OF THE, SOME OF THE DETAILS AND THE FEEDBACK THAT WERE PROVIDED AS PART OF COMMENTS WERE, YOU KNOW, SUPPORT FOR SUPPORT FOR DEMOLITION AS LONG AS, YOU KNOW, AN ENORMOUS MONSTER HOUSE WAS NOT CONSTRUCTED, HAS A REPLACEMENT FOR A MORE, UH, COM MODEST SIZE BUNGALOW, UH, PROFILE.
UM, AND THEN THERE WAS ALSO ANOTHER COMMENT THAT, UH, SUPPORTED THE DEMOLITION AS LONG AS NO, UH, ROCK HOUSES OR ROCK STRUCTURES ON SITE WERE DEMOLISHED.
AND SO, UM, THE FINDINGS TO SUMMARIZE PLANNING DEPARTMENT DOES CONSIDER THE DEMOLITION REQUEST FOR, UH, STRUCTURES 1, 2, 3, 4, 6, AND EIGHT TO BE APPROPRIATE.
ALSO NOTING THE PROPERTY OWNER AND THE FAMILY, THE FAMILY, UH, OF MS. YBA WILSON, SUCCESSFUL EFFORTS TO, UH, MEMORIALIZE MS. VIOLA WILSON'S CONTRIBUTIONS TO THE CULTURE AND EDUCATION OF THE COMMUNITY OF BERNIE THROUGH THE NAMING OF A NEW ELEMENTARY SCHOOL IN HER HONOR.
SO I WILL, I WILL, UM, PAUSE HERE AND ALLOW THE COMMISSIONERS TO, UM, INITIATE THE PUBLIC HEARING PROCESS.
UM, AT THIS OPPORTUNITY, I MEAN AT THIS MO TIME, WE'RE GONNA CLOSE THIS PORTION AND OPEN IT UP FOR PUBLIC COMMENTS.
AND IF ANYBODY WOULD LIKE TO COME UP TO ADDRESS THE HISTORIC LANDMARK COMMISSION, YOU CAN DO THAT AT THIS TIME FOR, UM, THIS DEMOLITION REQUEST LOCATED AT 3 0 8, UH, WEST SAN ANTONIO.
ALL RIGHT, SEEING NO MOVEMENT IN THE AUDIENCE, NOBODY WANTS TO SPEAK ANY FURTHER ON THIS AT THIS TIME.
PUBLIC COMMENTS FOR IN FAVOR OR, UH, NOT IN FAVOR OF IT.
ALRIGHT, I'M GONNA GO AHEAD AND CLOSE THE PUBLIC COMMENTS, UM, AT THIS TIME.
ALRIGHT, WE'RE GONNA OPEN IT BACK UP FOR COMMISSIONERS TO DISCUSS THIS ACTION ITEM.
UM, I WILL MAKE A NOTE THAT MYSELF AND COMMISSIONER BATEMAN, HE'S NOT HERE TONIGHT, UM, DID HAVE AN OPPORTUNITY TO VISIT THE LOCATION.
UM, I CAN'T REMEMBER THE EXACT DATE, BUT ABOUT TWO WEEKS AGO, UH, WE GOT THE DAY OF A SITE VISIT HERE AND, UH, WE HAD A GOOD TOUR GUIDE THERE WITH US THAT DAY AND WE SURE APPRECIATE THAT.
UH, SHOW US AROUND AND TALK ABOUT THINGS ON THE SITE.
UM, YOU KNOW, LIKE WAS PRESENTED, YOU KNOW, THE EXTERIOR, THE, UM, BUILDING, YOU KNOW, LIKE SEE AT BEST OF SIDING ON THE SIDE, TYPICAL 1950S STYLE THAT WE'VE SEEN HERE, UM, COME TO US, UH, MANY TIMES, UM, FOR THESE TYPE OF THINGS.
UM, YOU KNOW, THEN THE WINDOWS, SOME OF THE WINDOWS IN THE FRONT ARE ORIGINAL, PROBABLY NOT A HUNDRED PERCENT SURE, BUT THEY DO LOOK LIKE IT, LOOK IT, BUT MAJORITY OF THE EX EXTERIOR OTHER OUTSIDE ON THE NORTH SIDE AND THE WEST SIDE LOOK LIKE THEY'RE NEW CASEMENT WINDOWS.
THEY'RE NOT ORIGINAL TYPE, UM, SINGLE, THE REST OF 'EM ARE PROBABLY THE ORIGINAL SINGLE PANE WINDOWS.
SO, UM, YOU KNOW, THERE IS SOME WOOD ROTTS, UH, AROUND THE EXTERIOR OF THE BUILDING.
WE DID NOT GET TO GO INTO THE BUILDING ITSELF, BUT, UM, YOU CAN TELL FROM THE OUTSIDE IT IS A APPEAR AND BEAM.
UM, THE APPLICANT MIGHT BE ABLE TO TALK A BIT MORE ABOUT THE INTERIOR, BUT, UM, YOU KNOW, TYPICAL,
[00:20:01]
UM, WOOD FLOORS THAT ARE IN THE HOUSE LOOKS LIKE LOOK AT THE WINDOWS.BUT, UM, I'M NOT SURE ON THE, IF IT'S UNLEVEL OR NOT, I COULD NOT TELL FROM AT THE OUTSIDE, BUT, UM, BUT THERE IS SOMEBODY LIVING IN THE HOUSE AT THIS TIME.
UM, SO ANSWER THAT, UH, WHICH ONE SECOND.
HOLD ON, JUST HOLD ON ONE SECOND.
UM, BUT EVERYTHING ELSE, YOU KNOW, UM, I DON'T FORESEE THIS AS, YOU KNOW, A HISTORIC SITE, UM, FOR THE CITY OF BURNING.
BUT, UM, OBVIOUSLY WE ALL CAN DISCUSS AT THIS TIME, BUT YOU KNOW, IT, IT'S TYPICAL WHAT WE'VE SEEN IN THIS AREA, THE FLATS, UM, YOU KNOW, THE BUNGALOW STYLE HOUSES.
UM, BUT I'LL JUST LET Y'ALL DISCUSS THAT AS WELL.
AND UM, AGAIN, IF YOU DO WANT TO COME UP AND ADDRESS THE HISTORIC LANDMARK MISSION, YOU CAN DO THAT AT THIS TIME OR ANYBODY ELSE IF YOU'D LIKE TO DO THAT.
NO, I'LL JUST INCLUDE SURE, COME ON.
I'LL LET YOU STATE YOUR NAME FOR THE RECORD.
UH, YOUR MOM WANTS TO HEAR THAT.
SO
UM, TO ANSWER YOUR QUESTION IN REGARDS TO THE, TO THE FLOORING, IT IS WOOD FLOORING AND THEN ALSO LINOLEUM.
UM, I HAVE NOT BEEN INSIDE THE HOUSE 'CAUSE IT'S BEEN RENTED OUT FOR THE PAST MANY YEARS.
UM, SO MY RECOLLECTIONS OF IT FROM 15 TO 20 YEARS, IT WAS UNEVEN.
THEN I REMEMBER
SO TO ANSWER THAT QUESTION, IT IS WOOD FLOORING IN SOME LINOLEUM IN THE KITCHEN, IN THE BATHROOM AREAS, BUT NOTHING OF, OF ANY SIGNIFICANCE AS FAR AS THE FLOORING IS CONCERNED.
I KNOW THERE, YOU KNOW, IT'S BEEN ADDED ON A FEW, LOOKS LIKE MAYBE ONCE OR TWICE IN THE BACK OF THE HOUSE, UM, OVER THE, I MEAN, PROBABLY MANY, MANY YEARS AGO, BUT IT HAS BEEN ADDED ON FROM THE ORIGINAL STYLE OF THE HOUSE TOO.
I DON'T SEE ANY, UH, ANYTHING THAT'S HISTORIC JUMPING OUT.
AND I ALSO THINK, UH, COMMISSIONER THAT, UH, IT'S APPROPRIATE TO LET PEOPLE KNOW THAT OUR AUTHORITY JUST LIES WITH THE APPROVAL OF THE DEMOLITION, NOT ANYTHING THAT'S COMING IN THE FUTURE.
YEAH, I WAS GONNA MENTION THAT, BUT YES, YOU BEAT ME TO IT.
BUT YEAH, I MEAN THIS, WE ARE JUST, UM, APPROVING THE ACTUAL DEMOLITION OF THIS RESIDENCE, UH, AND THE OUTBUILDINGS THAT'S BEEN REP REPRESENTED HERE, UM, AS WELL.
UM, SO WHATEVER NEW STRUCTURE'S GONNA BE BUILT THERE, THE APPLICANT WILL HAVE TO GO THROUGH THE CITY, UH, PLANNING DEPARTMENT TO GET APPROVAL FOR ALL THAT PROCESS.
SO WE ARE JUST APPROVING THE ACTUAL DEMOLITION.
UM, SAME THING WITH THE TREES.
I MEAN, THEY'LL HAVE TO WORK IN THE CITY AS WELL, PRESERVING TREES, WHATEVER.
UM, THE ONLY THING I DO HOPE THEY DO FIND A HOME FOR OLD DOZER OUT THERE, SO, UH, THAT TURTLE CAN FIND A NEW HOME.
SO YES,
I DON'T KNOW WHAT KIND OF TURTLE IT WAS.
SO, SO, UM, ANY OTHER QUESTIONS OR COMMENTS? IS THIS THE, MY, MY QUESTION, IS THIS THE ONLY HOME THAT HAS A CHAIN LINK FENCE? 'CAUSE I SEE IT'S THE RECOMMENDATION THAT THAT'S PUT IN THE, UH, NO, THERE'S OTHER, UM, PROPERTIES IN THE, IT'S WITHIN THE CITY LIMITS, UH, BERNIE, BUT THE NEW, UH, UDC UM, GUIDELINES DON'T ALLOW CHANGING FENCES OR ANY LONGER.
UM, SO EVERYTHING HAS TO BE A WOODEN FENCE OR SOME OF THE KIND OF STRUCTURE NEW STRUCTURES NOW.
SO THAT'S THE ONLY REASON WHY IT'S MENTIONED IN THERE.
IF YOU DON'T MIND, I DO WANNA JUST STATE FOR THE FACT THAT THIS THIRD ONE THAT WAS JUST BROUGHT TO US, YOU KNOW, IN FAVOR OF DEMOLITION, BUT IS CONCERNED ABOUT WHAT WOULD BE GOING THERE NEXT.
UM, YOU KNOW, WE'RE LOOKING AT HOMES THAT WE'VE DENIED DEMOLITION IN THE PAST 'CAUSE THEY WERE BUILT IN THE 1920S.
WELL, YOU KNOW, IN 30 SOMETHING YEARS THESE HOMES ARE GONNA BE THAT OLD MM-HMM
SO I THINK THAT WE DO HAVE SOME RESIDENTS OUT THERE THAT ARE CONCERNED ABOUT LOSING THIS ERA OF HOMES.
NO, THAT WE'VE TALKED ABOUT THAT MANY TIMES, YOU KNOW? MM-HMM
I KNOW SOME OF THOSE 1920 HOMES, UH, WE'VE TRIED TO PRESERVE, UM, AS BEST, AS BEST WE CAN.
I MEAN, THE NEXT 20 YEARS OR SO, THESE HOUSES, THESE ARE GONNA BE THAT OLD, NOT THAT OLD.
SO, AND IF WE, UM, YOU KNOW, KEEP LOSING, WHAT IF ALL OF 'EM ARE GONE? YEAH.
KEEP LOSING THOSE CHARM THAT WE HAVE CONSIDERED BURNING.
UM, THAT'S SOMETHING DEFINITELY WE DON'T HAVE TO DISCUSS AND ADDRESS AT THAT TIME MM-HMM
BUT, UM, IT'S A VERY GOOD VALID POINT.
WE DON'T LOSE THE CHARM OF BERNIE.
UM, WE TRY TO PRESERVE IT BEST WE CAN.
IF ANYBODY ELSE, ANY QUESTIONS OR COMMENTS, LOOK FOR A MOTION THEN, UH, MR. CHAIRMAN, I, UH, MOVE TO APPROVE THE DEMOLITION PERMIT FOR THE STRUCTURES ENUMERATED IN THE MOTION, UH, STRUCTURES 1, 2, 3, 4, 6, AND EIGHT WITH THE, UH, STAFF STIPULATIONS OF THE CHAIN LINK FRONTS ON THE PROPERTY, BE REMOVED AS PART OF THE DEMO AND MAKING SURE THAT THE HERITAGE TREES ARE PRESERVED.
ALRIGHT, HAVE A FIRST ON THE FLOOR FOR APPROVING THE DEMOLITION REQUEST.
HAVE A SECOND AS WELL, AN OPPORTUNITY FOR EVERYBODY TO VOTE AT THIS TIME.
[00:25:03]
ALRIGHT, THAT PASSES FOUR TO ZERO.YOU ARE WELCOME TO MOVE FORWARD AND WORK WITH THE CITY OF BERNIE TO GET THE PAPERWORK DONE FOR THAT.
SO I PROMISE THAT HUGE
CAN'T SEE WHAT, WE'LL SEE WHAT HAPPENS.
[5.B. Consider a request for a demolition permit for the structure(s) located at 615 North School Street.]
NEXT ON THE AGENDA IS FIVE B.THIS IS AN ACTION ITEM 2 0 2 5 DASH THREE FOUR.
THIS IS A CONSIDERATION FOR A DEMOLITION PERMIT OF A STRUCTURED LOCATED AT SIX 15 NORTH SCHOOL STREET.
SO THE APPLICANT FOR THIS SECOND DEMOLITION PERMIT REQUEST IS AMITY PROPERTY INVESTMENTS.
WE DO HAVE, UM, REPRESENTATIVES FROM THE COMPANY HERE WITH US THIS EVENING, AND SO, UM, YOU KNOW, WE WILL BE ABLE TO HEAR FROM THEM IF THE COMMISSIONERS HAVE QUESTIONS ABOUT THE, UM, OVERALL CONDITION OF THE PROPERTY.
UM, SO THE PROPERTY THAT'S AT THE CENTER OF THE DEMOLITION REQUEST IS SIX 15 NORTH SCHOOL.
UH, THE PROPERTY IS LOCATED OUTSIDE OF THE HISTORIC DISTRICT, BUT IS OLDER THAN 50 YEARS.
AND, UM, THE SUBDIVISION IS A DIFFERENT ONE.
SO EARLIER WE WERE, WE WERE LOOKING AT THE IRONS AND GRAHAMS SUBDIVISION.
THIS ONE IS THE TOPPER WINE, UM, AND LEASH AT LEASH EDITION SUBDIVISION, WHICH WAS PLATTED, UM, UM, SIGNIFICANTLY LATER THAN THE, UM, IRONS AND GRAHAM ONE, BUT TO, UH, GET TO THE REQUEST.
UM, HERE WE SEE A STREET VIEW IMAGE OF THE PROPERTY OR THE STRUCTURE LOCATED AT SIX 50 NORTH SCHOOL, UM, WHICH WAS BUILT IN 1949 AS SINGLE FAMILY RESIDENCE.
WE SEE THAT MID-CENTURY, UM, SORT OF LONG RAMBLING WIDE, UM, TYPE OF, UH, RANCH STYLE HOME.
AND WE KNEW THAT THIS RESIDENCE PREVIOUSLY BELONGED TO THE MEKEL FAMILY.
UM, AND THEN AT THE TIME OF, UM, MR. MECKEL'S PASSING, IT WAS SOLD TO AMITY PROPERTY INVESTMENTS LLC IN 2020.
SO, UM, THE HISTORIC LANDMARK COMMISSION DID HAVE THE OPPORTUNITY TO DO A SITE VISIT AND, UM, THAT WAS BACK IN MARCH.
UM, SO WE HAVE HERE SOME SORT OF, UH, CLOSER VIEWS OF THE FRONT ELEVATION OF THE PROPERTY.
UM, WE DO SEE A COMBINATION OF, UH, WOOD TYPE OF SIDING, LIMESTONE VENEER, UH, SIDING AS WELL ON THE STRUCTURE.
UM, IN ADDITION, WE DO SEE THAT THE DOORS APPEAR TO BE, UH, ORIGINAL TO THE STRUCTURE, INCLUDING, UM, I WOULD WAGER THE THE GARAGE DOOR.
UM, IT LOOKS TO BE PRETTY WEATHERED THE, UH, THE REAR ELEVATION OF THE PROPERTY.
UM, THIS DOES INDICATE THAT THERE WERE PROBABLY SOME, UH, EITHER, YOU KNOW, BUILDING EXTENSIONS OR ADDITIONS OFF OF THE PATIO HERE.
UM, THE WINDOWS APPEAR TO HAVE BEEN ADDED PERHAPS CIRCA 1970.
AND SO, UM, JUST SOMETHING TO CONSIDER THAT THERE ARE, UM, VARIOUS PERIODS OF WINDOWS, UM, ON, ON THE STRUCTURE, BUT THAT THE, UM, THE DOORS AND THE GARAGE DOOR APPEAR TO BE ORIGINAL.
UM, IN ADDITION TO THOSE OBSERVATIONS FOR THE STRUCTURE.
UM, ANOTHER ELEMENT TO JUST CALL ATTENTION TO ON THE SITE IS A CHAIN LINK FENCE.
UM, WHICH WE KNOW FROM THE PREVIOUS CASE IS NOT PERMITTED, UH, ACCORDING TO OUR UNIFIED DEVELOPMENT CODE, UM, THERE'S ALSO AN ABUNDANCE OF MATURE TREES ON THE LOT.
AND SO, UM, WE WOULD WANT TO STIPULATE AS A CONDITION THAT THOSE MATURE TREES BE PRESERVED, UM, WHENEVER POSSIBLE, YOU KNOW, ACCORDING TO THE HEALTH OF, OF THE TREES.
UM, AND SO WE HAVE HERE, UM, JUST A SUMMARY OF ANALYSIS, THE THINGS THAT WE TALKED ABOUT CONCERNING THE PROPERTY BASED ON OUR, UH, SITE VISIT.
UM, ASIDE FROM THOSE, UH, ELEMENTS, UM, ARCHITECTURAL ELEMENTS, THE HERITAGE TREES, THE CHAIN LINK FENCE, UM, WHEN WE DID OUR RESEARCH, UH, AT THE CITY OF BURN FOR HISTORIC RECORDS FOR THE PROPERTY, UM, THERE WAS, THERE WAS NO, UH, RECORDS THAT WOULD SUGGEST THAT IT HAS ANY SIGNIFICANT, UM, HISTORICAL,
[00:30:02]
CULTURAL OR EDUCATIONAL VALUE.AND SO, UM, ASIDE FROM THOSE, THOSE FACTS, UM, WE ALSO HAVE CONSIDERATION OF THE PUBLIC RESPONSES THAT WERE RECEIVED, BOTH IN FAVOR OF THE DEMOLITION AND AGAINST DEMOLITION.
AT THE TIME OF POSTING OF THE AGENDA, UH, AND AGENDA PACKET ITEMS, THERE WAS ONLY TWO, UH, RESPONSES THAT WERE RECEIVED AT TIME OF POSTING ONE IN FAVOR OF DEMOLITION AND ONE AGAINST.
UM, AS OF TODAY, WE HAD TWO ADDITIONAL, UM, PUBLIC NOTICE NOTICES THAT WERE, OR COMMENTS THAT WERE MAILED TO US.
AND SO I'M HAPPY TO SHARE THOSE WITH THE COMMISSIONERS FOR CONSIDERATION.
IN TERMS OF THE COMMENTS THAT WERE RECEIVED IN FAVOR OF DEMOLITION, UM, THAT ONE RESPONSE DID INDICATE THAT, UM, THEY HAD KNOWLEDGE OF THE CONDITION OF THE PROPERTY AND THAT SIGNIFICANT INVESTMENT WOULD BE REQUIRED IN ORDER TO MAKE IT, UH, YOU KNOW, LIVABLE ACCORDING TO, UM, CURRENT STANDARDS.
UH, THE OTHER RESPONSES THAT WERE RECEIVED AGAINST THE DEMOLITION, UM, INDICATE CONCERN OVER, YOU KNOW, POTENTIAL REDEVELOPMENT OF THE SITE AND, UM, JUST CONCERN WITH, UM, PRESERVING THE, THE, I GUESS, RESIDENTIAL ASPECT OF THE NEIGHBORHOOD, UM, WITH, YOU KNOW, BUNGALOWS AND, AND, UM, THAT TYPE OF THING.
SO, UM, IN TERMS OF SOME SUMMARIZING OUR, OUR FINDINGS, UM, STAFF FINDS THAT THE PROPOSED DEMOLITION OF THE PRIMARY RESIDENCE IS APPROPRIATE, UH, WITH THE FOLLOWING STIPULATION STIPULATIONS.
SO SIMILAR TO THE OTHER PROPERTY, UM, THAT THE CHAIN LINK FENCE ON THE PROPERTY BE REMOVED AS PART OF THE DEMOLITION AND THAT THE MATURE HERITAGE TREES ON SITE BE PRESERVED, UM, IF THEY ARE IN GOOD HEALTH.
AND I WILL SEED MY TIME BACK TO THE COMMISSIONERS, UM, FOR PUBLIC HEARING.
ALL RIGHT, WE'RE GONNA CLOSE THIS PORTION AND, UH, WE'LL OPEN THIS UP FOR A PUBLIC COMMENTS.
UM, THIS IS YOUR OPPORTUNITY TO ADDRESS THE HISTORIC LANDMARK COMMISSION TO, UH, TO APPROVE OR DENY OR WHEREVER YOU MAY WANNA SPEAK, UH, UPON THIS PROPERTY LOCATED AT SIX 15 NORTH SCHOOL STREET.
UM, ANYBODY IN THE PUBLIC COMMENTS YOU WANNA COME UP AND ADDRESS, STATE YOUR NAME, UM, OPPORTUNITY FOR YOU TO DO THAT.
GOOD AFTERNOON AND THANK YOU FOR YOUR TIME TODAY.
CAN YOU, COULD YOU STATE, STATE YOUR NAME FOR THE RECORD? I'M, I'M, OH, I'M SORRY.
MY NAME IS ALAN AND MY WIFE IS DONNA AND WE OWN THE PROPERTY AT SIX 15 SCHOOL STREET.
UH, AS MENTIONED, THE ORIGINAL HOME WAS BUILT IN THE LATE 1940S.
WE BOTH GREW UP IN SMALL COMMUNITIES, SMALLER THAN BERNIE, IN FACT, AND WE APPRECIATE THE, ALL THE HISTORICAL VALUE AND THE, THE CULTURAL, UH, NEED AND THE, THE, THE QUAINT NEIGHBORHOODS, SO FORTH AND SO ON.
UM, WE'VE BEEN TAKING CARE OF THE PROPERTY, ACTUALLY IT'S THREE INDIVIDUAL LOTS, UH, MOWING, ET CETERA.
WE WE'RE GONNA ALWAYS TAKE CARE OF IT 'CAUSE WE WANT IT TO LOOK NICE IN THE NEIGHBORHOOD AND WE WILL CONTINUE TO DO THAT.
WE'VE HAD THE PROPERTY ON THE MARKET SEVERAL TIMES ALONG WITH THE OLD GARAGE EDITION, WHICH ENCROACHES SLIGHTLY ONTO THE ADJACENT LOT.
WE'VE, UH, THE, THESE ASPECTS HAVE BEEN NEGATIVE TO POTENTIAL BUYERS FOR THE PROPERTY.
THE HOUSE IN ITS CURRENT STATE IS UNINHABITABLE AND WOULD COST TOO MUCH FOR US TO UPDATE IT AND BRING IT UP TO CURRENT CODES FOR THAT REASON.
UM, AND, AND WE HAVE NO CURRENT PLANS FOR THE PROPERTY.
WE JUST WANTED TO GET IT CLEANED UP.
THAT SAID, THE NEIGHBORHOOD AND THE CITY OF BURN FOR THE NEIGHBORHOOD AND THE CITY OF BERNIE.
WE LOOK FORWARD TO THE POTENTIAL THAT THE THREE LOTS OFFER THAT ADHERES TO CURRENT CITY CODES, UH, AND BENEFITS THE NEIGHBORHOOD OVERALL.
THANK YOU AND I'D, I'D BE GLAD TO ANSWER ANY QUESTIONS YOU MAY HAVE.
UM, WE MAY HAVE OTHER QUESTIONS LATER ON, SO I, I APPRECIATE YOUR COMMENTS AND APPRECIATE YOU ADDRESSING US FOR THAT.
[00:35:01]
THANK YOU.ANYBODY ELSE IN THE AUDIENCE? I
I LIVE IN THE VICINITY 3 0 3 WEST FREDERICK STREET.
AND, UM, MR. ALLEN AND DONNA ARE, DONNA DIDN'T SPEAK ALLEN DEAD OF, OF AMITY PROP PROPERTIES, UH, MAKES THEMSELVES SOUND LIKE THEY'RE THE PERFECT BERNIE FAMILY.
HOWEVER, AMITY PROPERTIES IS OUT OF GEORGIA, THEY'RE NOT LOCAL AND THEY HAVE ALREADY BEEN ON THE PROPERTY TEARING DOWN BUILDINGS WITHOUT PERMISSION.
YES, THEY OWN IT, BUT THEY DIDN'T GET PERMISSION TO TEAR 'EM DOWN.
UM, WHEN THEY BOUGHT IT FROM THE MEKEL CHILDREN, THEY WEREN'T UPFRONT AND FORWARD ON THEIR PLANS.
THIS IS WORD I'VE GOTTEN THROUGH THE MEKEL FAMILY.
UM, AND THEY HAVE ALREADY ATTEMPTED TO SUBDIVIDE IT BY PROPERTY ON LIVE OAK, GET THE LIVE OAK RESIDENT PERMISSION TO PUT A DRIVEWAY THROUGH THERE.
THEY'VE SPOKE OF PUTTING MULTIPLE DWELLINGS IN THAT, ON THOSE LOTS.
UM, AND I'M NOT SURE WHY WE SHOULD CALL 'EM LOTS BECAUSE IT'S REALLY ONE BIG PIECE OF PROPERTY.
I DON'T HAVEN'T HEARD OF IT BEING SUBDIVIDED AS TO THIS POINT.
I KNOW THEY REQUESTED AT ONE POINT AND IT WAS DENIED.
UM, I JUST DON'T FEEL LIKE AMITY PROPERTIES HAVE BEEN UPFRONT AND HONEST WITH THE MECO FAMILY, WITH PROBABLY THE CITY.
UM, AND I JUST HAVE STRONG FEELINGS ABOUT BIG CORPORATE COMPANIES COMING INTO BERNIE NEIGHBORHOODS UNDER DIS UNDER THE GUISE OF BEING THESE WONDERFUL NEIGHBORHOOD PEOPLE AND WHAT TURNS OUT FROM IT IS NOT A WONDERFUL NEIGHBORHOOD ADDITION.
UM, AND I KNOW LIKE YOU SAID EARLIER, YOU DON'T HAVE ANY CONTROL OF WHAT THEY DO WITH THE PROPERTY OTHER THAN THE DEMOLITION PORTION, BUT, AND I'M NOT SURE WHY HE SAYS IT'S UNINHABITABLE, UM, HOW HE'S MADE THAT DECISION OR WHO MADE THAT DECISION IF IT'S BEEN CONDEMNED, I HAVEN'T HEARD OF THAT.
UM, AND I KNOW YOU CAN'T ANSWER QUESTIONS, BUT BOTH ON THE PRIOR PROPERTY AND THIS PROPERTY, I WOULD HAVE THE QUESTION OF WHO DETERMINES IF THE MATURE TREES ARE HEALTHY OR NOT.
UM, DOES AN ARBORIST COME OUT? AND IF SO, WHO YOU KNOW IS RESPONSIBLE FOR THAT PAYMENT AND UM, REPORT.
UM, THAT'S MY CONCERN ABOUT THE NEIGHBORHOOD AND MAINTAINING WHAT BERNIE IS.
APPRECIATE BOTH OF Y'ALL'S COMMENTS.
ANYBODY ELSE WOULD LIKE TO COME UP TO ADDRESS THE HISTORICALLY LANDMARK COMMISSION? WOULD YOU LIKE TO COME BACK UP OR, I'M, WE MAY HAVE QUESTIONS FOR YOU WHEN WE GET TO THE ACTUAL ACTION ITEMS, SO, BUT YOU CAN COME BACK UP AND STATE YOUR NAME AGAIN.
THANK, ALRIGHT, UH, ALAN COOK.
UM, I APPRECIATE EVERYTHING THAT SHE SAID AND I RESPECT THAT.
UM, I'M NOT SURE WHERE SHE CAME UP WITH THE FACT THAT WE ARE A HUGE CORPORATION.
WE LIVE OUTSIDE OF BERNIE, UM, ON A SMALL RANCH AND HAVE FOR SEVEN YEARS WE BUILT OUT HERE AND WANNA BE A PART OF THE COMMUNITY.
SO, UM, I'M NOT SURE WHERE THAT CAME FROM.
AND, UH, I JUST WANNA SAY THAT, UH, WHAT WE DO AND WHAT WE HAD PLANNED TO DO ON THE PROPERTY, WE DECIDED NOT TO DO.
UM, AND THERE WAS A LOT OF SPECULATION ABOUT WHAT WE WERE GONNA DO OR NOT GONNA DO.
AND ALL WE TRY TO DO IS BE HONEST WITH PEOPLE.
[00:40:01]
US ABOUT ANYTHING, WE'RE GLAD TO DO THAT IN THE PRIOR, UH, IN THE PRIOR TIME BECAUSE WE WERE GONNA BUILD ON THE PROPERTY MM-HMMAND IN FACT WE MET WITH THE CITY AND THE CITY ENCOURAGED US TO BUILD WHAT WE WERE GONNA BUILD AND, UM, THERE'S NO PROOF OF THAT BUT THEY, THEY DID.
WE WANT TO BE A PART OF THIS COMMUNITY.
WE ARE PART OF THIS COMMUNITY.
WE LIVE HERE, WE'RE NOT A BIG CORPORATION, IT'S JUST MY WIFE AND I AND WE BUY REAL ESTATES FROM TIME TO TIME AND RESELL IT AND WE ALWAYS CLEAN IT UP.
WE LOOK AT MAKE IT LOOK BETTER THAN IT WAS AND WE WOULD DO STUFF TO IMPROVE THIS NEIGHBORHOOD, NOT DEGRADE IT.
SO WE WOULD HOPE SOME SINGLE FAMILY HOMES AND IF THE CODES CHANGE TO MAKE 'EM LOOK LIKE BUNGALOWS, THAT WOULD BE GREAT.
THAT'S WHAT, IF THAT'S WHAT BERNIE WANTS TO DO, THAT WE WOULD BE TOTALLY SUPPORTIVE OF THAT.
SO I JUST WANNA SAY WHEN, WHEN PEOPLE COME UP WITH INFORMATION AND THEY DON'T KNOW THE PEOPLE THAT THEY'RE TALKING ABOUT, MAYBE THEY SHOULD SPEND SOME TIME TO GET TO KNOW US BEFORE THEY MAKE COMMENTS ABOUT US THAT THEY HAVE NO IDEA ABOUT.
ALRIGHT, ANY OTHER COMMENTS FOR THIS ACTUAL ACTION ITEM?
SHARON, CARLY AGAIN? YES MA'AM.
UH, WHERE I GOT MY INFORMATION WAS FROM THE PLANNING AND ZONING.
I ASKED THEM ABOUT AMITY PROPERTIES INVESTMENTS AND THEY TOLD ME THEY WERE OUT OF GEORGIA.
THAT'S WHERE I GOT MY INFORMATION.
ALRIGHT, I'M GONNA GO AHEAD AND CLOSE THE ACTUAL PUBLIC COMMENTS THIS TIME, SO NOBODY ELSE WOULD LIKE TO COME UP.
ALRIGHT, WE'RE GONNA CLOSE THE PUBLIC COMMENTS AND OPEN IT BACK UP FOR THE ACTUAL ACTION ITEM FOR US TO DISCUSS.
UM, THIS APPLICATION HERE FOR DEMOLITION REQUEST FOR SIX 15 NORTH SCHOOL STREET.
UM, UH, ONCE AGAIN I WAS ABLE TO VISIT THE ACTUAL SITE, UH, WITH COMMISSIONER BATEMAN, UH, A FEW WEEKS AGO.
UM, YOU KNOW, IT, THERE'S SOME VERY MATURE TREES IN THE PROPERTY.
UM, I MEAN, I, I'LL JUST ANSWER YOUR QUESTION.
I MEAN, THE CITY DOES GO OUT THERE AND, UM, DOES, DOES REVIEW THE TREES ON THE PROPERTY TO MAKE SURE TO STATE THAT YOU KNOW WHICH ONES ARE MATURE TREES AND WHICH ONES COULD BE TAKEN OR NOT.
SO THE CITY IS INVOLVED WITH THAT PORTION OF THAT, SO I'LL JUST LET YOU KNOW THAT.
SO IT'S NOT, THEY CAN JUST GO CUT TREES DOWN.
SO, UM, SO HOPEFULLY THAT ANSWERS PART OF YOUR QUESTION ON THAT.
SO, UM, BUT THE HOUSE ITSELF, YEAH, I MEAN IT'S, IT'S AN OLDER HOUSE.
UM, YOU KNOW, THERE ARE, LOOKS LIKE THERE MAY BE SOME ORIGINAL WINDOWS IN THE FRONT, BUT ALL THE ONES IN THE BACK AND THE SIDES HAVE BEEN REPLACED WITH MORE MODERN, UH, WINDOWS.
SOME SINGLE PANE WINDOWS IN THE FRONT.
UM, THE INTERIOR WE DID NOT GET TO GET, GO INTO THE INTERIOR OF THE HOUSE.
UM, WAS, HAD WOOD FLOORS IN IT.
IT DID LOOK LIKE IT DID HAVE LOOK UNEVEN IN THE HOUSE A LITTLE BIT.
UM, AGAIN, WE, I WAS NOT ABLE TO WALK INTO IT TO CONFIRM THAT, BUT JUST LOOKING THROUGH IT, IT DID LOOK LIKE IT HAD SOME SETTLING ON THE PRUM BEAM.
UM, YOU KNOW, THERE ARE SOME WOOD ROCKS IN ON THE EXTERIOR OF THE HOUSE, UM, ITSELF, UM, IN CERTAIN AREAS AS WELL, UM, ON THIS OLDER HOME AS WELL.
SO, UM, AGAIN, DON'T REALLY SEE ANYTHING HISTORIC ON THIS STRUCTURE OF IT IS VERY SIMILAR TO VERY ONES THAT WE'VE SEEN HERE IN THE LAST SEVERAL IN THE LAST YEAR OR SO THAT WE'VE, UM, THAT'S COME TO US AS WELL.
UM, YOU KNOW, THESE TYPE OF STYLE HOUSES, UM, THE ROCK THERE IS ROCK ON THE EXTERIOR OF THE HOUSE.
I DUNNO IF THAT WAS ORIGINALLY THERE WHEN THE HOUSE WAS BUILT.
UM, BUT THERE ARE SOME, THE, THE SIDING THAT IS ON THERE, IT DOES LOOK LIKE THAT'S BEEN REPLACED PROBABLY, I DON'T KNOW HOW LONG AGO, BUT, UM, DOES NOT LOOK LIKE IT'S ORIGINAL SIDING ABOVE THE ROCK ITSELF.
UM, SO THE OVERALL, UM, JUST LET Y'ALL DISCUSS THAT.
THE APPLICANT IS HERE IF YOU'LL HAVE QUESTIONS, FURTHER QUESTIONS I'M SURE HE'LL BE GLAD TO COME UP AND ADDRESS THE HISTORIC LANDMARK COMMISSION.
AND AGAIN, TOO, LIKE I MENTIONED BEFORE, WE ARE HERE JUST TO APPROVE THE DEMOLITION REQUEST.
WE'RE NOT HERE TO APPROVE ANY OTHER ACTION ITEMS FOR STRUCTURES TO BE BUILT OR, UM, THE LOT, IF THERE IS SOME KIND OF SUBDIVIDING OF THE LOTS OR SOMETHING LIKE THAT, WE'RE NOT HERE TO DISCUSS THAT AS WELL.
SO THEY LET THE APPLICANT LET THE GO TO THE CITY OF BERNIE TO GET THE PROPER ZONING FOR THE LOT ITSELF FOR FURTHER STUFF.
ALRIGHT, ANYTHING ELSE THAT I MISSED? UH, NO, YOU DID A GREAT JOB.
UM, JUST KIND OF ADDRESSING SOME OF THE CONCERNS SURE.
THAT WERE RAISED THIS EVENING.
UM, ONE ADDITIONAL, UH, CONCERN THAT WAS RAISED WAS THE DEMOLITION OF, UM, YOU KNOW, POTENTIALLY SHED STRUCTURES OR OTHER STRUCTURES, UH, ON THE SITE WITHOUT A PERMIT.
UM, YOU KNOW, HAVING, HAVING JUST DISCUSS THAT WITH OUR CHIEF BUILDING OFFICIAL, UM, YOU KNOW, IF, IF A STRUCTURE IS NOT HISTORIC AND IF IT IS NOT HOOKED UP TO ANY UTILITIES,
[00:45:02]
UM, YOU KNOW, A PROPERTY OWNER IS WITHIN THEIR RIGHTS TO DEMOLISH A MINOR, MINOR SHED THAT IS NOT HISTORIC AND THAT DOES NOT HAVE ANY UTILITIES LIKE ELECTRICITY OR WATER OR, YOU KNOW, ANY SORT OF PLUMBING, UH, RUNNING TO IT WITHOUT, UM, A DEMOLITION PERMIT.UM, IN ADDITION, UM, YOU KNOW, JUST AS A MATTER OF MATTER OF PUBLIC RECORD, UM, THE PLANNING, UH, AND ZONING DEPARTMENT DOES NOT GIVE OUT, UH, YOU KNOW, THE FINER DETAILS OF THE LOCATIONS OF APPLICANTS, UM, AS A, A MATTER OF PROTECTING PRIVACY.
BUT WE WILL SHARE, UH, YOU KNOW, FACTS THAT ARE A MATTER OF PUBLIC RECORD.
AND SO, UM, IF PEOPLE DID ASK WHO THE APPLICANT WAS IN THIS CASE, WE DID SHARE THAT IT WAS AMITY PROPERTY INVESTMENTS, LLC.
AND THAT'S FAIR FOR US TO SHARE THAT INFORMATION BECAUSE IT'S PUBLIC RECORD.
UM, I CANNOT SPEAK TO ANY OTHER DETAILS THAT, YOU KNOW, UM, WERE TALKED ABOUT THIS EVENING.
UM, AND THEN LASTLY, IN TERMS OF THE TREE PRESERVATION, YOU'RE CORRECT, UH, MR. CHAIR, AS PART OF THE PLATTING PROCESS, WE WOULD HAVE A LAND STUDY AND THEN, UM, WE WOULD HAVE A TREE PRESERVATION PLAN AS PART OF A LAND STUDY AND ANY PROPOSED PLATING, UM, OR RE PLATTING OF THE PROPERTY.
AND SO ANY, ANY, UM, ANY TREES THAT ARE IDENTIFIED AS HERITAGE TREES ON SITE MUST BE PRESERVED.
UM, AND IF THEY ARE TO BE TAKEN DOWN THEN THEY, THE APPLICANT HAS TO PAY A A FEE AND IT'S QUITE HEFTY TO TAKE DOWN THOSE TREES.
UM, IF, IF THEY'RE IN FACT HEALTHY TREES, IF IT IS A TREE THAT IS DISEASE DEAD A HAZARD, THEN IT'S A DIFFERENT CASE.
BUT I DID JUST WANNA PROVIDE THOSE ADDITIONAL DETAILS FOR THE COMMISSIONER'S CONSIDERATION THIS EVENING.
ALRIGHT, UH, COMMISSIONERS, ANY QUESTIONS I DISCUSS FURTHER.
AND IF NOT, UH, NO QUESTIONS OF THE APPLICANT LOOK FOR CONSIDERATION OF A MOTION TO APPROVE OR DENY AT THIS TIME.
UH, MR. CHAIRMAN, I MAKE A MOTION TO APPROVE A ACTION ITEM 2 0 2 5 DASH 34, THE REQUEST FOR A DEMOLITION PERMIT FOR THE STRUCTURE LOCATED AT 6 1 5 NORTH SCHOOL STREET.
ALRIGHT, I HAVE A MOTION TO APPROVE AND A SECOND ON THE FLOOR AS WELL.
OPPORTUNITY FOR Y'ALL TO VOTE AT THIS TIME.
ALRIGHT, THAT MOTION, UH, IS APPROVED WITH THREE TO ONE SO IT IS APPROVED.
UM, ACTUALLY YOU CAN MOVE FORWARD WITH THAT WORKING WITH THE CITY OF BERNIE.
DO APPRECIATE Y'ALL ALL TO COME OUT TONIGHT AND DISCUSS THIS ACTION ITEM.
UM, YOU KNOW, IT IS IMPORTANT TO REVIEW THESE STRUCTURES BEFORE ANY OTHER ADDITIONAL ACTION ITEMS OR PRESENTED.
[5.C. Consider a request for a certificate of appropriateness for a new sign located at 231 South Main Street, Suite D. (Texas Treasures Co. Frame Shop & Gallery)]
WE WILL MOVE ON TO THE NEXT ACTION ITEM.UM, THIS IS FOR FIVE C, THIS IS 2 0 2 5 DASH 1 3 5.
THIS IS A CONSIDERATION OF REQUEST FOR CERTIFICATE APPROPRIATENESS FOR A NEW SIGN LOCATED AT UH, 2 2 3 1 SOUTH MAIN STREET, SUITE DA NEW PRESENTER TONIGHT.
YES, GOOD EVENING COMMISSIONERS.
SO I WAS TRYING TO BE MINDFUL OF THE COMMISSION'S TIME AND THE CERTIFICATES OF APPROPRIATENESS THAT WE HAVE BEFORE US THIS EVENING ARE ALL FOR THE SAME COMPANY AND THAT IS TEXAS TREASURE'S COVE FRAME, SHOP AND GALLERY.
HOWEVER, THOSE THREE CERTIFICATES OF APPROPRIATENESS ARE SPREAD OUT BETWEEN TWO DIFFERENT LOCATIONS.
SO, UH, FOR THE SAKE OF EASE OF PRESENTATION, I THOUGHT IT WOULD BE USEFUL TO PROVIDE A COLLECTIVE PRESENTATION ON ALL OF THE CERTIFICATES OF APPROPRIATENESS BEFORE US THIS EVENING.
HOWEVER, AT THE END WE CAN STILL VOTE ON EACH OF THE CERTIFICATES OF APPROPRIATENESS AND THE SIGNED PERMITS INDIVIDUALLY TO MAINTAIN THAT INTEGRITY PROCEDURALLY.
OKAY, SO THE UH, AGAIN, TWO DIFFERENT LOCATIONS THIS EVENING FOR TEXAS TREASURE'S CO FRAME SHOP AND GALLERY.
THE FIRST IS 2 31 SOUTH MAINE SUITE D AND THERE IS A CORRESPONDING ROOF SIGN CERTIFICATE OF APPROPRIATENESS ASSOCIATED WITH THAT ADDRESS.
THIS SECOND LOCATION IS 1 95 SOUTH MAIN SUITE A, WHICH HAS BOTH A WALL SIGN AND A HANGING SIGN CERTIFICATE OF APPROPRIATENESS ASSOCIATED WITH IT.
THE APPLICANT IS CIRCLE H SIGNS PAUL HOLY CAMP ON BEHALF OF JEAN REBI AND JOHNNY ROSA.
SO STARTING OFF WITH AGENDA ITEM FIVE C.
SO THE 2 31 SOUTH MAIN SUITE D ROOF SIGN,
[00:50:01]
THIS IS NORTH OF JAMES AND THE UH, EAST OF MAIN.AND IN TERMS OF THE STRUCTURE ITSELF, IT WAS CONSTRUCTED CIRCA 1966, HAS KIND OF A COURTYARD LAYOUT.
I'M SURE EVERYONE HERE IS FAMILIAR WITH THIS BUILDING.
UH, IT HAS A MAIN STREET COMMERCIAL AND SINGLE STORY TEXAS RANCH SLASH RAMBLER ARCHITECTURAL STYLE.
THE FACADE FEATURES WOOD, BRICK STUCCO AND MASONRY WITH A SHED STYLE STANDING SEAM METAL ROOF OVER THE FRONT PORCH.
IT IS A CONTRIBUTING STRUCTURE TO THE HISTORIC DISTRICT AND IT'S CURRENTLY UTILIZED AS A COMMERCIAL BUILDING.
SO THE NEW PROPOSED ROOF SIGN AGAIN WILL BE OVER SUITE D.
IT IS A METAL RECTANGULAR SIGN PANEL MEASURING 48 INCHES IN HEIGHT AND 96 INCHES WIDE.
HAS A BEIGE BLACKGROUND BACKGROUND, PARDON ME, WITH BLACK SERIF TYPE FONT AND IT IS NON LITT SO NO ILLUMINATION.
NOW I'M TAKING US A LITTLE BIT NORTH OF MAIN STREET TO 1 95 SOUTH MAIN SUITE A, WHICH HAS BOTH A NEW WALL SIGN AND A NEW HANGING SIGN.
A CERTIFICATE OF APPROPRIATENESS REQUEST ASSOCIATED WITH IT THIS EVENING.
SO AGENDA ITEMS FIVE D AND FIVE E RESPECTIVELY.
SO THIS IS TO THE NORTH OF ROSEWOOD AND AGAIN STILL TO THE EAST OF MAIN.
THIS STRUCTURE WAS CONSTRUCTED CIRCA 1977 WITH A MAIN STREET COMMERCIAL ARCHITECTURAL STYLE AND THE FACADE FEATURES MASONRY WOOD AND STUCCO WITH A STANDING SEAM METAL ROOF.
IT IS A CONTRIBUTING STRUCTURE TO THE HISTORIC DISTRICT AND IT IS ALSO CURRENTLY UTILIZED AS A COMMERCIAL BUILDING.
I WANNA TAKE A MOMENT, UH, TO SPEAK BRIEFLY ON THE STREET VIEW THAT YOU SEE.
SO WHAT IT WAS PREVIOUSLY, THE FORMER TENANT WALL SIGN, SO THAT'S CLOSEST TO THE WALL TO THE EYE OF THE VIEWER, WILL BE UNDER CONSIDERATION THIS EVENING FOR A NEW WALL SIGN AS WELL AS THE HANGING SIGN WHICH IS BENEATH THE FRONT PORCH ON THE MAIN ENTRY.
SO THE PROPOSED WALL SIGN FIRST AGENDA ITEM FIVE D IS A METAL SIGN MEASURING 96 INCHES WIDE AND 48 INCHES TALL.
HAS A BLACK BACKGROUND WITH BEIGE SIFF TYPE FONT, HAS THREE TOTAL COLORS, ONE FONT TYPE AND IS ALSO NOT AN ILLUMINATED SIGN.
THE HANGING SIGN FOR THE SAME LOCATION.
ALSO A METAL SIGN FACE MEASURING 28 INCHES WIDE AND FIVE INCHES IN HEIGHT.
IT'S A BLACK BACKGROUND WITH BEIGE SERIF TYPE FONT, THREE TOTAL COLORS, ONE FONT TYPE AND IS ALSO NOT ILLUMINATED.
SO ALL OF THESE CERTIFICATES OF APPROPRIATENESS AND THE SIGN PERMITS ARE SUBJECT TO THE SAME CRITERIA WITHIN THE UDC AND THE HISTORIC DISTRICT REQUIREMENTS.
SO I WILL EVALUATE EACH OF THEM INDIVIDUALLY.
IT WILL FEEL REDUNDANT, BUT IT IS MEANT TO BE COMPREHENSIVE.
SO FIVE C, THE ROOF SIGN THAT IS PROPOSED AT 2 31 SOUTH MAIN SUITE D HAS A RECTANGULAR SIGN FACE, METAL MATERIAL, FOUR COLORS OR LESS.
A MAXIMUM OF TWO FONTS IS NON LITT AND COMPLIMENTS THE BUILDING FACADE.
AND IN THIS WAY IS IN ALIGNMENT WITH THE UDC AND THE HISTORIC DISTRICT REQUIREMENTS FOR THE WALL SIGN AGENDA ITEM FIVE D AT 1 95 SOUTH MAINE.
THIS ALSO MEETS THE UDC AND HISTORIC DISTRICT REQUIREMENTS BY FEATURING A RECTANGULAR SIGN FACE MADE OF METAL MATERIAL, FOUR COLORS OR LESS, MAXIMUM OF TWO FONTS, NOT ILLUMINATED AND COMPLIMENTS, COMPLIMENTS THE BUILDING FACADE.
AND LAST BUT NOT LEAST, FIVE E THE HANGING SIGN FOR THE 1 95 SOUTH MAIN SUITE.
A ADDRESS IS ALSO IN ALIGNMENT WITH UDC AND THE HISTORIC DISTRICT REQUIREMENTS IN THAT IT HAS A RECTANGULAR SIGN FACE FEATURES, METAL MATERIAL HAS FOUR COLORS OR LESS, A MAXIMUM OF TWO FONTS IS NOT ILLUMINATED AND ALSO COMPLIMENTS THE BUILDING FACADE.
SO WITH THAT DEMONSTRATING ALIGNMENT WITH THE UDCN HISTORIC DISTRICT REQUIREMENTS FOR ALL THREE OF THE CERTIFICATES OF APPROPRIATENESS BEFORE YOU THIS EVENING ACROSS THE TWO LOCATIONS, STAFF RECOMMENDS APPROVAL FOR ALL OF THE CERTIFICATES OF APPROPRIATENESS, BUT SPECIFICALLY AGENDA ITEM FIVE C, A NEW ROOF SIGN PERMIT REQUEST AT 2 31 SOUTH MAIN SUITE D AGENDA ITEM FIVE D, A NEW WALL SIGN PERMIT REQUEST AT 1 95 SOUTH MAIN SUITE A AND AGENDA ITEM FIVE E, A NEW HANGING SIGN PERMIT REQUEST AT 1 95 SOUTH MAIN SUITE A.
AND AT THIS POINT WE CAN CONSIDER EACH OF THEM INDIVIDUALLY.
SO, UH, THE FIRST MOTION FOR YOUR CONSIDERATION IS WITH REGARD TO THE NEW ROOF SIGN PERMIT REQUEST AT 2 31 SOUTH MAIN SUITE D.
[00:55:01]
SIR.UM, OKAY, WE'RE GONNA VOTE ON EACH ONE OF THESE SEPARATELY, LIKE WAS MENTIONED.
UM, SO WE'LL KIND OF GO THROUGH THESE, BUT YOU KNOW, I THINK WE'VE ALL SEEN THOSE AND IF YOU HAVE QUESTIONS I'M SURE WE CAN HELP, HELP ANSWER SOME OF THOSE.
SO, UM, WE'LL GO TO THE FIRST ONE HERE AS WE TALKED ABOUT.
CORRECT ME IF I'M WRONG, BUT I THOUGHT I CAME ACROSS SOMETHING THAT SAID ONE OF THE SIGNS IS WOOD IS DID I READ THAT SOMEWHERE OR WAS THAT I THINK THEY'RE ALL METAL METAL.
MY UNDERSTANDING IS THAT THEY'RE ALL METAL MATERIAL.
BUT I THOUGHT ONE OF THE NOTES SAID THAT IT WAS A OH IT DOES THE LAST ONE.
OH IS IT THE LAST ONE? THE UNDER THE PORCH, THE HANGING HANGING SIDE.
YEAH, IT SAYS WOODEN FIVE INCHES BY 28 INCHES.
THIS IS YEAH, MDO, BUT I MEAN IF YOU WOULD RATHER HAVE MIDDLE MAX, I'M SURE YOU COULD PUT THAT IN YOUR MOTION, BUT IT IS MDO WOOD SIGN.
AND, AND THAT'S FOR WHICH NUMBER? THIS IS FOR THE SMALLER ONE.
THE ACTION ITEM OR NEXT NUMBER THREE? THE FIVE E.
SO IT IS NOT A METAL MATERIAL MDO WOOD MATERIAL.
YEAH, IT IS BUT IT'S IF YOU, BUT THE, Y'ALL ARE SAYING IT'S METAL IN YOUR PRESENTATION IN THE PRE, SHE MENTIONED ALL OF THIS COULD BE METAL MAX, BUT AGAIN, THE PRESENTATION, IT SAYS MDO SO IF YOU OKAY.
WISH TO CHOOSE TO CHANGE THAT, YOU CAN MAKE THAT IN YOUR MOTION WHEN WE GET TO THAT PORTION.
BECAUSE THE APPLICANT'S NOT HERE, I DON'T THINK THEY'RE NOT DISCUSS THAT ANYMORE.
I HAD SAW IT OR, OR I SAW IT AND I JUST SOMETIMES I'LL JUST LIKE TO VERIFY.
NO, THANK YOU FOR CATCHING THOSE.
YEAH, WE'LL GO THROUGH EACH ONE OF THESE AND WE CAN MAKE THAT UH, MOTION WHEN WE GET TO THAT PORT PART FOR FIVE E.
SO, OKAY, FIRST ONE WE'RE LOOKING AT IS FIVE C.
THIS IS A CONSIDERATION ON THE REQUEST FOR CERTIFICATE APPROPRIATENESS FOR A NEW SIGN LOCATED AT 3 2 3 1 SOUTH MAIN STREET, UH, SUITE D, TEXAS TREASURE, UH, COMPANY FRAME, SHOP AND GALLERY.
UM, OFFICER WE WENT OVER THAT.
UM, IT IS A NEW ROOFS, UM, YEAH FOR A NEW SIGN THERE AT THAT LOCATION THAT'D BE STRUCTURED ON TOP OF THE ROOF.
SO I DON'T RECALL ARE ALL THE OTHER SIGNS ROOF SIGNS THAT TALL? THIS, I MEAN THIS ONE'S THE PICTURE MIGHT BE DISTORTED A LITTLE BIT.
IT'S UM, IT'S FOUR FEET TALL SO IT'S YEAH, THE SIZES OF THE OTHER, IS THERE A PICTURE ROOF SIGNS IN THAT STRUCTURE? IT DOES APPEAR TO BE IN ALIGNMENT WITH THE CHARACTERISTICS OF THE OTHER SIGNS IN THAT IT WAS HARD TO TELL IN THE PICTURE.
YES, SOMETIMES THEY'RE NOT ALWAYS DRAWN TO SCALE.
UH, MR. CHAIRMAN, I MOVE TO APPROVE THE ACTION ITEM 2025 DASH 1 35 AS PRESENTED.
OKAY, GOT IT FIRST AND HAVE A SECOND OPPORTUNITY FOR EVERYBODY TO VOTE.
IT IS A LITTLE CONFUSING TRYING TO FIGURE OUT WHAT'S LINE UP.
ALRIGHT, THAT PASSES FOUR TO ZERO, THAT ONE'S GOOD TO GO
[5.D. Consider a request for a certificate of appropriateness for a new sign located at 195 South Main Street, Suite A. (Texas Treasures Co. Art Gallery)]
UH, NEXT IS FIVE D 2 25 DASH 1 3 6.THIS IS A CONSIDERATION OF REQUEST FOR A CERTIFICATE APPROPRIATENESS FOR A NEW SIGN LOCATED AT 1 9 5 SOUTH MAIN STREET, SUITE A.
AND AGAIN, THAT'S IN YOUR PACKET.
UM, IT IS FOR THE WALL SIGN AT THE CORNER OF MAIN STREET AND ROSEWOOD TO REPLACE THE EXISTING SIGN THAT'S THERE.
NOW MR. CHAIRMAN, I MOVE TO APPROVE THIS DIFFERENT, UH, I DO HAVE, UH, SO I THOUGHT I SAID THOUGHT I READ SOMEWHERE THAT IT WAS GOING, THIS, THIS SIGN WAS GOING TO BE IN THE CURRENT BLACK METAL FRAME.
THAT METAL FRAME IS NO LONGER THERE.
SO IS THERE GONNA BE A NEW ONE INSTALLED? I CAN CLARIFY WITH THE CONTRACTOR? YES MA'AM.
YEAH, I MEAN I THINK IT, IT HAD ONE BEFORE SO YEAH, I TOOK A LITTLE SHORTCUT TO GET TO THE CITY HALL
SO IF YOU PUT THAT IN YOUR MOTION, IF YOU WOULD LIKE TO HAVE A METAL FRAME LIKE IT HAD BEFORE YOU COULD DO THAT MM-HMM
CAN YOU BRING UP THE REFERENCE PHOTO? YES SIR.
SEE THAT BLACK FRAME? IT'S GONE.
AND I THOUGHT I READ THAT THEY WERE GOING TO REPLACE THE NEW SIGN IN THAT SAME BLACK FRAME AS PART OF OUR SIGN REVIEW.
WE DO HAVE BUILDING INSPECTORS REVIEW IT FOR STRUCTURAL SOUNDNESS.
UM, BUT I CAN CLARIFY WITH THE CONTRACTOR, UM, AESTHETICALLY AND IN TERMS OF THE HISTORIC LANDMARK COMMISSION GUIDELINES, IT DOES ALIGN WITH THOSE THAT ARE BEFORE
[01:00:01]
YOU THIS EVENING FOR CONSIDERATION.UH, MR. CHAIRMAN, I MOVE TO APPROVE ACTION ITEM 2025 DASH 1 36 AS PRESENTED WITH THE CAVEAT THAT UH, THE METAL MAX SIGN HAVE SOME TYPE OF BORDER AROUND IT TO, UH, TO COVER THAT EDGE.
WHETHER IT'D BE LIKE THE ORIGINAL PHOTO, UH, I DON'T KNOW, IT LOOKS LIKE MAYBE A ONE BY THREE INCH THREE YEAH.
OKAY, I'LL LEAVE THAT UP TO, TO STAFF AND CITY.
WE'LL MAKE SURE IT STAYS WITHIN THE PROJECTION LIMITS AS WELL FROM THE WALL, SOMETHING LIKE THAT.
THE MOTION ON THE, ON THE FLOOR IS TO APPROVE THE CERTIFICATE APPROPRIATE FOR THIS WALL SIGN WITH THE CAVEAT AND MAKE SURE THE APPLICANT HAS THE, UH, FRAME LOCATED AROUND IT FRAME LIKE IT WAS BEFORE.
OPPORTUNITY FOR EVERYBODY TO VOTE AT A FIRST AND A SECOND.
ALRIGHT, THAT PASSES FOUR TO ZERO, THAT ONE'S GOOD TO GO AS WELL.
[5.E. Consider a request for a certificate of appropriateness for a new sign located at 195 South Main Street, Suite A. (Texas Treasures Co. Art Gallery)]
NEXT IS FIVE E.CONSIDERATION OF A CERTIFICATE OF PROPS FOR A NEW SIGN LOCATED AT 1 9 5 SOUTH MAIN STREET.
AGAIN, THIS IS THE ONE, THE HANGING SIDE UNDER THE PORCH.
AND AGAIN MENTION THAT MDO IF YOU'D RATHER HAVE SOMETHING ELSE, YOU STATE THAT IN YOUR MOTION AS WELL.
MR. CHAIRMAN, I MOVE TO APPROVE ACTION ITEM 2025 DASH 1 37 AS PRESENTED WITH THE CAVEAT THAT THE SIGNED MATERIAL BE CHANGED FROM MDO TO METAL MAX OR MAX METAL.
HAVE A FIRST AND A SECOND ON THE FLOOR.
OPPORTUNITY FOR EVERYBODY TO VOTE AT THIS TIME IS ACTION ITEM FIVE E.
ALRIGHT, THAT PASSES AGAIN FOUR TO ZERO.
GUESS YOU'LL LET THE APPLICANT KNOW AND ENJOY THE NEW LOCATION.
[6. COMMENTS FROM COMMISSION/LEGAL COUNSEL/STAFF – No discussion or action may take place.]
ON THE AGENDA IS, UM, COMMENTS FROM UH, LEGAL STAFF OR JUST STAFF OF BERNIE, NATHAN? NOTHING.I JUST HAVE ONE QUICK COMMENT.
UM, WE ARE GONNA DO THIS PEANUT BUTTER DRIVE THIS MONTH.
THE PLANNING DEPARTMENT AND PERMITTING AND CODE COMPLIANCE DEPARTMENT ARE COMING TOGETHER TO DO THIS FOR BLESSINGS IN A BACKPACK.
UM, IF YOU ALL ARE INTERESTED, I'M HAPPY TO, UM, COME TO YOUR LOCATION OR MEET YOU ANYWHERE OR IF YOU ARE ABLE TO STOP BY AND WANTED TO DONATE, FEEL FREE, UM, TO DO SO HERE AT CITY HALL ON THE SECOND FLOOR.
BUT ALSO YOU HAVE MY PHONE NUMBER, EMAIL IF YOU WANNA REACH OUT.
SO IS THERE A DATE, CUTOFF DATE OR, YES.
SO IT'LL BE THROUGH THE MONTH OF APRIL.
I JUST WANTED TO NOTE I LIKE THE WAY THAT WAS PRESENTED AT THE END, THE WAY THAT WAS PUT TOGETHER FOR SPEED.
ALRIGHT, ANYTHING ELSE? MOVE TO ADJOURN.
GOT A FIRST? ANYBODY ELSE SECOND? I SECOND.
