LAST TIME I WAS IN A CITY COUNCIL CHAMBER, THE CONDITIONS WEREN'T THIS NICE, SO CONGRATULATIONS ON A NICE FACILITY, NICE NEW FACILITY, THANKFUL FOR IT.

LET'S PRAY.

HEAVENLY FATHER, WE JUST THANK YOU SO MUCH FOR THE OPPORTUNITY, GOD, THAT YOU GIVE US.

UM, AS LEADERS OF OUR COMMUNITY, GOD, AS PEOPLE WHO, WHO LOVE THE CITY OF BERNIE TO SERVE IN THIS, IN THIS RESPONSIBILITY.

GOD, THANK YOU FOR THAT.

GOD, WE UNDERSTAND THAT GOD, YOU ORDAINED PEOPLE WHO SERVED TO DO SO WITH AN INCREDIBLE RESPONSIBILITY.

ULTIMATELY, THEY LOVE THE CITY OF BERNIE AND THEY WANT WHAT'S BEST.

UM, OUR FIRST SPEAKER THIS EVENING IS MILAN, MILAN, MAYOR FRANK CITY COUNCIL.

UH, MY NAME IS MILAN ICK.

I RESIDE AT 12 GRANT ROAD IN KENDALL COUNTY, BUT I CONSIDER MYSELF EVERY PART OF THE COMMUNITY.

BERNIE AND I DO ENJOY LIVING IN BERNIE.

I, UH, COMMENT, ACTUALLY, SECOND PUBLIC HEARING ON THE ANNUAL BUDGET FOR FISCAL YEAR 26 PROMPTED ME TO SPEAK ANOTHER BUDGET REQUIREMENT, WHICH IS A WATER PLAN.

IF YOU DIDN'T KNOW IT, UH, WATER PLANNING COMMITTEE WAS CREATED BY UNANIMOUS VOTE OF BERNIE CITY, THE COUNCIL BACK IN 2020.

HE HAD A GOAL, QUOTE.

THE BERNIE COMMUNITY WATER PLANNING COMMITTEE IS BEING CREATED TO PERFORM RESEARCH THAT WILL LEAD TO PROPOSED LONG-TERM STRATEGIC AND FUNCTIONAL WATER PLAN FOR THE BERNEY COMMUNITY TEAM'S.

FIRST RESEARCH WAS CAPTURED IN A MEMO ENTITLED SUMMARY OF WATER CONSERVATION OPPORTUNITIES.

IT WAS AN EXCELLENT DOCUMENT, SEVEN PAGES LONG, AND IT, IT SATISFIED THREE OUTTA THE FOUR GOALS OF THE COMMITTEE WAS TASKED TO PERFORM.

HOWEVER, THE FOURTH GOAL WAS TO SEEK OUT AND EVALUATE POTENTIAL NEW WATER RESOURCES.

WHILE COMMITTEE LAST MET THAT I WAS AWARE OF, AND I ATTENDED MOST OF THE MEETINGS, NOT ALL OF THEM.

THE HIGHLIGHT THE AGENDA IS A REVIEW OF POTENTIAL SOURCES FROM GBRA AND THERE WAS A EMPHASIS ON URGENCY TO GET ON BOARD WITH THE NEW WATER.

AND YOU'RE MISS OUT.

THIS IS SWALLOWED BY A SAW REPRESENTATIVE WHO REVEALED THEIR WATER SYSTEM MIXES WATER FROM MULTIPLE SOURCES, ONE OF WHICH IS GROUNDWATER FROM THE EDWARDS AQUIFER.

CURRENT LAW PROHIBITS THIS EDWARDS WATER FROM BEING USED IN KENDALL COUNTY.

NOW, THEY'VE TRIED TO CHANGE THE LAW IN 2019.

THEY DID GET IT APPROVED AT THE LEGISLATURE.

THE GOVERNOR VETOED IT, TRY IT AGAIN IN 21, 23, AND 25.

SO THE LAW IS STILL IN PLACE.

VERY CLEAR.

IT'S IMPORTANT TO NOTE BEYOND THAT 2022 MEETING IN MARCH, NOTHING SIGNIFICANT WAS PRODUCED BY THE WATER COMMITTEE THAT I COULD FIND.

IT SIMPLY FADED FROM PUBLIC VIEW.

SUBSEQUENTLY, THE WEBSITE OF VALUABLE DATA WAS SHUT DOWN.

BY EARLY 2023, THE COMMITTEE LEADER HAD APPOINTED, HAD BEEN APPOINTED TO THE GBRA BOARD OF DIRECTORS.

IN MY OPINION, THE TASK TO SEEK OUT AND EVALUATE POTENTIAL NEW WATER RESOURCES WAS LEFT COMPLETE.

IN TURN, IT'S PROBABLY IMPACT THE COMPLETION OF A LONG TERM STRATEGIC PLAN.

NOW, HDR DID A LOT OF ANALYSIS IN 2022.

IT'S VERY CLEAR THAT THE WATER HAS A VERY, VERY, VERY SOLID WATER POSITION FOR THE CITY FOR A LONG PERIOD OF TIME.

NO ARGUMENT THERE.

AND, UH, NOW WE'RE BACK INTO 2025.

FAST FORWARDING.

AND GBA IS TOUTING SOMETHING CALLED WATER SECURE.

IT'S AN INCREDIBLY EXPENSIVE PROJECT AND LONG TERM TO GET THE WATER, UH, YOU FOR THANKFULLY HAVE DECLINED TO PARTICIPATE.

I ALSO NOTE THAT FAR OAKS RANCH HAS DONE THE SAME.

THEY'VE DECLINED TO PARTICIPATE.

HOWEVER, I WILL TELL YOU BY STUDYING THE REGIONAL WATER PLAN FOR REGION, THEY STATE THE REGIONAL PLANTERS STATE THAT YOU WILL TAKE THE WATER AS WELL AS FAR OAKS RANCH.

NOW, I'VE WRITTEN A PUBLIC COMMENT TO THE WATER PLANTERS POINTING THAT OUT.

AND THIS IS A PROBLEM.

'CAUSE AGAIN, THERE'S A PUSH TO GET NEW WATER AND IT'S VERY EXPENSIVE.

WE HAVE ALTERNATIVES AS YOU ALL HAVE EXPLORED VERY, VERY THOROUGHLY.

SO THE 2015 PLAN, UH, HAD OPTIONS FOR EVERYTHING INCLUDED, A INDIRECT PORTABLE REUSE, DIRECT PORTABLE REUSE, AND EXPANDING THE REUSE SYSTEM, WHICH IS EXCELLENT.

SO THE 10 YEAR ROLLING MASTER PLAN INCLUDES PROJECT TO DEVELOP A MASTER PLAN, AND IT'S BEEN STARTED, AND I SUGGEST THE EXPANSION OF THAT WATER PLAN BE COMPLETED AS SOON AS PRACTICAL TO AVOID A LOSS OF MOMENTUM TO BETTER PLAN FOR THE BERNIE COMMUNITY WATER FUTURE.

WE'RE FINALLY TO THE POINT OF ADOPTION FOR FISCAL YEAR 2026.

THIS IS THE SECOND PUBLIC HEARING ON THE BUDGET AND THE TAX RATE, TONIGHT'S PRESENTATION IS ESSENTIALLY GONNA BE THE SAME PRESENTATION THAT OCCURRED ON AUGUST 26TH, UM, IN ADVANCE OF THE FIRST PUBLIC HEARING, SO THAT ANY, UM, AUDIENCE THAT COMES TO EITHER PUBLIC HEARING WILL ESSENTIALLY HEAR THE SAME INFORMATION.

THIS, OF COURSE, IS OUR STRATEGY MAP, AND THE BUDGET PROCESS ALIGNS WITH THE MAP TO ENSURE THAT ALL OUR DOLLARS SUPPORT OUR COMMUNITY'S LONG-TERM GOALS.

HERE'S THE ROADMAP FOR TONIGHT.

UM, PRESENTATION, UM, AS MAYOR STATED, IS GOING TO BE COVERING THE NEXT THREE AGENDA ITEMS. AFTER THIS PRESENTATION, WE WILL BREAK FOR THE PUBLIC HEARING ON THE BUDGET.

WE'LL, UM, SEE THOSE TWO ITEMS, AND THEN WE WILL BREAK FOR ANOTHER PUBLIC HEARING ON THE TAX RATE, FOLLOWED BY THE ORDINANCE TO ADOPT THE TAX RATE.

SO IT HAS BEEN A LONG ROAD TO GET TO TONIGHT.

UM, JUST AS A REMINDER TO ANYBODY THAT MAY BE WATCHING, OUR BUDGET PROCESS STARTS ALMOST AS SOON AS WE, UM, ADOPT THE ONE YEAR'S BUDGET.

WE START THE NEXT BUDGET CYCLE.

SO STARTING BACK IN JANUARY, UH, WE HAD PLANNING WORKSHOPS, DEPARTMENTS BEGAN TO LOOK AT THEIR BUDGETS, AND THEY CAME TOGETHER IN APRIL WHERE WE REFINED RANKED PRIORITIES AND MET WITH COUNCIL AND HELD OUR SUMMER WORKSHOPS.

SO BY THE TIME WE'RE REACHING THIS POINT IN AUGUST,

THE BUDGET HAS ALREADY BEEN THROUGH SEVERAL ROUNDS OF REVIEW AND SEVERAL PUBLIC MEETINGS AND WORKSHOPS IN DISCUSSION.

SO THIS IS THE LAST ITEM ON OUR, OUR AGENDA.

IT'S EXCITING.

HERE'S OUR BUDGET GUIDING PRINCIPLES.

AND AS PART OF OUR BUDGET WORKSHOPS OVER THE SUMMER, WE WALKED THROUGH IN DETAIL HOW THESE GUIDING PRINCIPLES ALIGNED WITH OUR BUDGET PROCESS THIS YEAR.

AS WELL AS, UM, THIS IS HOW WE PIECED TOGETHER THE BUDGET.

WE'VE WALKED THROUGH HOW WE MAKE SURE EACH PART ALIGNS WITH THE STRATEGIC GOALS AND LEGAL REQUIREMENTS OF THE PROCESS.

LET'S TAKE A MOMENT AND LOOK HIGH LEVEL AT THE NUMBERS.

OUR PROPOSED BUDGET IS 181 MILLION MADE UP OF THREE DIFFERENT KINDS OF FUNDS.

YOU HAVE YOUR GENERAL FUNDS OF 43 MILLION SPECIAL REVENUE FUNDS OF 50 MILLION AND UTILITY FUNDS OF 88.

32% OF THE OVERALL BUDGET IS CIPU OR CAPITAL IMPROVEMENT PROJECT FUNDING.

THAT EQUALS 57 MILLION.

AND OF THAT 39% IS RELATED TO OUR BOND PROJECTS.

OUR BUDGET HAS 19 FUNDS, 12 OF WHICH ARE GOVERNMENTAL.

SEVEN ARE UTILITY, WHICH MEANS THAT THEY ARE NOT SUPPORTED BY PROPERTY TAXES OR TAXES.

THEY'RE SUPPORTED BY USER CHARGES FOR THOSE UTILITIES.

GENERAL FUNDS ARE PART OF THE OVERALL GOVERNMENTAL FUNDS.

THESE ARE THE FUNDS THAT, WHEN YOU THINK OF THE MAINTENANCE AND OPERATION PORTION OF YOUR PROPERTY TAX RATE, THESE ARE THE FUNDS THAT ARE SUPPORTED BY THAT.

THE OTHER PART OF YOUR PROPERTY TAX RATE IS THE INS, WHICH IS INTEREST IN S SINKING OR YOUR DEBT RATE.

AND THAT SUPPORTS YOUR DEBT SERVICE FUND.

SO THERE'S A LOT OF NUMBERS ON THIS SLIDE, BUT IT OVERALL BREAKS OUT THAT 181 MILLION BY FUND WHERE THAT BUDGET IS SITTING, THE BUDGET YEAR OVER YEAR INCREASE FROM LAST YEAR.

AND MOST OF THAT 40 MILLION OF IT IS RELATED TO CIP OR CIP RELATED FUNDING.

AND SO I'VE STARRED THOSE FUNDS.

YOU CAN SEE THAT THOSE ARE THE FUNDS THAT ARE GIVING RISE TO THAT CHANGE.

THIS SLIDE BREAKS OUT THE $43 MILLION IN THE BUDGET, THE INCREASE YEAR OVER YEAR BY FUND.

SO HOW MUCH OF AN INCREASE OR DECREASE FROM LAST YEAR EACH FUND HAD, AND THOSE STARS CARRIED OVER FROM THE PREVIOUS SLIDE.

SO THAT YOU CAN SEE THAT THE BULK OF THAT INCREASE IS IN THOSE CAPITAL RELATED PRO PROJECT FUNDS, EITHER CONSTRUCTION FUNDS OR WHAT, WHAT WE CONSIDER A FUNDING FUND.

SO WE HAD A REALLY, REALLY EXCELLENT QUESTION, UM, THAT WE'LL GET TO IN JUST A SECOND.

THIS IS, THIS IS AGAIN, A BREAKDOWN OF THE INCREASE, THE $43 MILLION OF THAT, THE 40 40 MILLION IS CIP RELATED.

UH, 1.2 MILLION IS ONE TIME INCREASES.

AND OPERATIONALLY WE ONLY SAW $1.5 MILLION OR 1.7% INCREASE ACROSS ALL FUNDS.

SO THE, THE GREAT QUESTION WAS, UM, SARAH, IF YOU'RE LOOKING AT YOUR CIP FROM LAST YEAR AND YOUR CIP THIS YEAR, THAT ONLY INCREASED 24 MILLION.

SO HOW ARE YOU SAYING THAT CIP RELATED, UM, INCREASES WERE 40 MILLION? AND THE ANSWER TO THAT IS THAT THERE WAS $16 MILLION OF CIP RELATED FUNDING TRANSFERS.

AND SO THIS GRAPHIC IS GONNA HELP WALK THROUGH WHAT THAT MEANS.

SO, FOR INSTANCE, THE CAPITAL RECOVERY FUND, ALL IT DOES IS IT HOLDS OUR IMPACT FEES.

AND THOSE IMPACT FEES, THEIR, THEIR GOAL IS TO FUND, UM, APPLICABLE PROJECTS, PROJECTS THAT APPLY FOR IMPACT FEES.

SO FOR INSTANCE, IF THE WATER FUND HAS A $15 MILLION INFRASTRUCTURE PROJECT THAT NEEDS TO BE FUNDED BY IMPACT FEES, THAT FUND BALANCE IS SITTING IN THE CAPITAL RECOVERY FUND, YOU HAVE TO DO A TRANSFER FROM THE CAPITAL RECOVERY FUND TO THE WATER FUND IN ORDER TO FUND THAT INFRASTRUCTURE.

SO WHAT HAPPENS IS EACH FUND IS BALANCED, YOU HAVE REVENUE, YOU HAVE EXPENSE, THEY'RE BALANCED, BUT THE BOTTOM LINE LOOKS LIKE A $30 MILLION BUDGET, EVEN THOUGH YOU ONLY HAVE A $15 MILLION INFRASTRUCTURE COST.

SO THAT'S, THAT'S WHY I DESIGNATED AS CIP RELATED VERSUS CIP CONSTRUCTION.

WERE THERE ANY QUESTIONS BEFORE WE MOVE INTO THE BUDGET PUBLIC HEARING? JUST, JUST REMIND THE PUBLIC THAT MIGHT BE LISTENING THAT THAT'S A STATE REQUIREMENT.

YES.

DOUBLE COUNTING, WHICH I ASKED ABOUT LAST TIME.

RIGHT, EXACTLY.

SO IT DOES, EVEN, EVEN ME COMING FROM THE PUBLIC SECTOR, THIS DID LOOK STRANGE AT FIRST BECAUSE IF YOU'RE LOOKING AT A NORMAL BUSINESS RECORDS, YOU'RE, YOU'RE USED TO LOOKING AT ACCOUNTING RECORDS OF A MULTINATIONAL COMPANY, THEY'RE GONNA HAVE, UM, BASICALLY AN ENTITY IN THERE THAT GETS RID OF ALL THIS INTER INTERCOMPANY TRANSFERS THAT DOESN'T EXIST IN THE BUDGET WORLD.

UM, YOU, YOU HAVE TO SHOW BALANCED FUNDS.

SO YOU, THERE, THEY HAVE SCHOOL DISTRICTS THAT THAT'S ISSUE A LOT OF DEBT 'CAUSE IT'S, AND, AND THEY ISSUE DEBT.

UM, AND I TRY TO BEEN BALANCED OPERATIONS.

AND ONE THING THAT WE'VE LEARNED OVER THE LAST FEW ECONOMIC CYCLES IS THAT, UM, THE ABILITY TO BUDGET CONSERVATIVELY AND HAVE POSITIVE, UM, FINANCIAL RESULT IS REALLY THE BEST JUDGMENT OF WHAT MANAGEMENT DOES.

AND, AND THIS MORNING, UH, WE HAD A, A AAA RATED SALE.

AND RAYMOND JAMES, UM, WON THAT.

THESE HERE, YOU KNOW, THE, WHEN I LOOK AT THESE, FIVE OF THESE FIRMS WOULD BE CONSIDERED THE TOP SEVEN UNDERWRITERS OF THESE TYPE BONDS.

AND, AND UNIQUELY, AS I WAS TELLING SARAH, I STILL HAVE TO LOOK AT BROWNSTONE INVESTMENT GROUP.

HAVEN'T SEEN THEM IN 2000 BIDS I'VE DONE.

AND SO YOU HAVE THE REALLY COMPETITIVE PEOPLE THAT ARE PURCHASING BONDS, UM, CONSISTENTLY IN THE STATE OF TEXAS AND REALLY COMPETING FOR 'EM WITH BOK FOCUSING ON YOUR ISSUE.

AND AS A RESULT, THEY WON.

AND NOT ONLY DID THEY WIN, BUT ONE THING I THOUGHT WAS REALLY INTERESTING AND I I DISCUSSED WITH SARAH, AS YOU LOOK AT THE SPREAD BETWEEN BOK AND RAYMOND JAMES, YOU SEE EIGHT BASIS POINTS ON OUR OTHER BIDS.

WE'LL SEE SPREADS LIKE ONE TO TWO BASE POINTS.

YOU KNOW, THESE FIRMS HAVE PRETTY SIMILAR COST OF CAPITAL AND, AND THEY UNDERSTAND THE MARKET AND, AND GENERALLY PRICE THINGS, HOW WE HAVE A VERY TRANSPARENT PRICING.

THEY WANTED THIS BOND ISSUE AND THEY BA BID THROUGH IT.

AND, AND WHEN WE TALKED ABOUT WHAT OUR METHOD OF SALE WOULD BE, I INDICATED IF SOMEONE HAS GOT HIGH CREDIT, VERY IMPORTANT AND, AND, UH, A WELL THOUGHT OF NAME, YOU WOULD EXPECT SOMEONE TO BID THROUGH IT AND I THINK BE OKAY.

UM, UH, VERY PLEASED TO TALK TO THEM WHEN THEY WANTED TO BID.

UH, THEY WERE VERY PLEASED TO HAVE THIS.

AND WHAT'S IT MEAN? UH, SPEND A LOT OF TIME TALKING ABOUT RATINGS AND THE RATING REPORT AND, AND HOW THIS WAS PRESENTED.

WHAT IT MEANS IS, IS SAVING MONEY FOR THE CITIZENS.

OUR PLAN OF FINANCIAL WAS ISSUED $4 MILLION OF BONDS AT ALL, AT ALL INTRU RATE OF 5.25%, AND, UM, A TOTAL PRINCIPAL AND INTEREST PAYMENT OF 5.4 MILLION.

TODAY WE ISSUED 3,995,000 OF BONDS.

UM, WE, UM, 5,000 LESS THAN WE ESTIMATED.

WE ACTUALLY CONTROLLED COSTS TO SQUEEZE THEM.

UH, WE WERE ACTUALLY $46,000 LESS IN OUR COST OF ISSUANCE FROM THE UNDERWRITERS DISCOUNT AND THE COST OF ISSUANCE AND THE DIFFERENCE IN INTEREST RATE BETWEEN WHAT WE PROJECTED.

AND I WILL BE FAIR, I WOULD SAY THAT WE, WE BUFFERED IT AT THE TIME.

WE NOTED IN OUR PRESENTATION THAT THE INTEREST RATES AT THE TIME WE RAN THE SCALE WOULD'VE BEEN RATED AT ABOUT 5%.

AND, AND THE MARKETS MOVED ABOUT 10%.

SO ON AN APPLES TO APPLE BASIS, YOU SHOULD HAVE MAYBE BEEN SOMEWHERE IN THE 4 85 TO UM, FOUR 90.

BUT, BUT AGAIN, BECAUSE OF THAT VERY POSITIVE RATING REPORT, THE LIMITED AMOUNT OF DEBT YOU HAVE OUTSTANDING TREMENDOUS APPETITE.

UM, ONE OF THE FIRST THINGS I LEARNED 30 PLUS YEARS AGO FROM MY MENTOR IS WHEN THERE'S UNCERTAINTY OF INTEREST RATES OR THE ECONOMY, PEOPLE WANT HIGH CREDIT QUALITY BONDS AND YOUR STRONG CREDIT QUALITY, UH, BROUGHT YOU TO THIS PLACE.

AND SO THE NET RESULT IS THAT, THAT THAT REDUCTION IN INTEREST RATE RESULTED IN A REDUCTION OF PROPOSED INTEREST OF 308,000, WHICH IS 22% LESS THAN THE INTEREST RATE, INTEREST COST WE HAD ON THE ORIGINAL PLAINTIFF ADVANCE.

AND AS YOU ARE AWARE, YOU KNOW, WE HAVE, UM, OVER THE LAST COUPLE OF YEARS HAS BEEN PUT IN SOME MORE STRINGENT, UM, RESTRICTIONS ON HOW YOU CAN RAISE REVENUE IF YOU NEED TO RAISE REVENUE.

UM, AND, AND I THINK THAT THAT REFLECTS THAT.

IT'S, IT'S PRETTY GOOD.

I'LL TELL YOU, THERE'S SOME STATES THAT DON'T HAVE AN A RATING 'CAUSE THEY'RE SO LIMITED IN WHAT THEIR CITIES HAVE, BUT IT REALLY REPRESENTS THE STATE STATUTES THAT ALLOWS THE CITY TO GENERATE REVENUES, UH, TO PUT RATES AND CHARGES IN PLACE FOR UTILITIES, ET CETERA.

SO THAT'S THE 3% CAP THAT THE STATE LET THE 3.5% CAP WITHOUT VOTER LIMITED EXCEPTIONS.

AND REMEMBER THIS RATING AND THIS PROCESS WAS TAKING PLACE WHEN, UM, WE WERE IN THE SPECIAL SESSION TALKING ABOUT OTHER RESTRICTIONS THAT MIGHT BE PUT IN PLACE.

BILL 1 0 0 8, A CITY IN THE STATE OF TEXAS CAN NO LONGER CHARGE A PREMISE, A FEE UNDER THE ALCOHOL BEVERAGE CODE IF THE PREMISE HAS ALREADY PAID A SIMILAR FEE TO OPERATE.

AND SO UNDER THAT UMBRELLA FEE TO OPERATE IS INCLUDED A FA FOOD PERMIT AND THOSE ARE ISSUED BY THE COUNTY.

SO, UM, WHAT WE DID WAS WE DID A CROSS REFERENCE OF THE LISTING FROM THE COUNTY OF EVERY ESTABLISHMENT THAT ALREADY HAD A FOOD PERMIT THAT WE BY LAW CAN NO LONGER, UM, ASSESS A ALCOHOL BEVERAGE LICENSE.

AND EVERY SINGLE ESTABLISHMENT THAT HAS AN ACTIVE LICENSE ALSO HAS A FOOD PERMIT.

SO THERE'S, THERE'S NO ESTABLISHMENT IN THE CITY THAT WE COULD EVEN ASSESS THIS FEE TO, EVEN IF WE WANTED TO.

SO, AND IT IS ON PAR WITH WHAT OUR PEER CITIES ARE DOING.

YOU'RE SEEING GENERALLY MOST CITIES ARE JUST REPEALING THEIR ALCOHOL BEVERAGE LICENSE RIGHT NOW UNTIL THEY CAN FIGURE OUT HOW TO WORK OUT A BETTER MECHANISM.

BUT FOR RIGHT NOW, UM, AS OF SEPTEMBER 1ST, 2025, WE'RE GONNA DISCONTINUE ISSUING, WE'RE RENEWING ALCOHOL BEVERAGE LICENSES.

THE, UM, THE GAME PLAN FROM HERE, WE HAVE A LETTER THAT'S READY TO GO OUT TO ALL OF OUR ALCOHOL BEVERAGE LICENSE PREMISE, UM, ESTABLISHMENTS, JUST LETTING THEM KNOW THAT THERE'S NO NEED TO RENEW THEIR LICENSES.

BUT THE BALANCE THAT YOU HAVE TO TAKE AS AN ELECTED OFFICIAL WHO TAKES AN OATH TO UPHOLD THE LAW IN BERNIE, IN KENDALL COUNTY, IN THE STATE OF TEXAS AND THE UNITED STATES IS DIFFERENT THAN THE EMOTIONAL COMMENTS YOU MAKE AS A CITIZEN.

I ACTUALLY LOOK BACK, UH, 'CAUSE THIS CAME UP THE OTHER NIGHT.

UH, I HAVEN'T, YOU KNOW, I GOT INVOLVED WITH THE BUCKY'S THING LONG BEFORE I WAS ON THE COUNCIL, AND I HAVE A NUMBER OF EMAILS PRIOR TO MY TIME ON THE COUNCIL AND MY FIRST EMAIL, WHICH WENT TO NOT ONLY THE HOA BUT TO MEMBERS OF THE CITY GOVERNMENT.

I READ IT AGAIN AND I THOUGHT ABOUT ACTUALLY READING IT TO SOMEBODY, BUT I DECIDED I WOULDN'T, I WOULD SAY MY ARTICULATION OF THE COMPLAINTS WERE FAR BETTER THAN ANYTHING YOU HEARD LAST NIGHT.

FAR BETTER AND FAR MORE AGGRESSIVE.

UM, BUT THAT WAS, AS A CITIZEN, THAT WAS AS A PERSON GIVING AN OPINION AND A CONCERN.

UM, WE IN THE ELECTED OFFICE HAVE A DIFFERENT, UM, UH, MISSION, NOT TO NOT LISTEN, BUT WE HAVE TO WEIGH ALL KINDS OF FACTORS AS WELL AS THE LEGALITY OF ACTIONS OF PREVIOUS ADMINISTRATIONS, PREVIOUS, UH, UH, CITY MANAGERS, PREVIOUS CITY ATTORNEYS, PREVIOUS CITY MAYORS, UM, AND WHATEVER WE THINK OF THOSE PEOPLE, OF THOSE ACTIONS, UH, WE CAN CRITICIZE THEM AND, AND I HAVE, BUT WE HAVE TO WEIGH ALL THAT.

WE DON'T GET TO JUST IGNORE THAT IT HAPPENED AND, AND YOU DON'T GET JUST A DO OVER BECAUSE YOU DON'T LIKE SOMETHING.
