THEY'RE ON THE ON PLAN LEFT AND THEN TO THE SOUTH THROUGH THE EXISTING SUBDIVISION.
NO NEW CURB CUTS ARE PROPOSED OR REQUIRED.
UM, PER UDC STANDARDS, SEVEN PARKING SPACES ARE REQUIRED.
THE SITE PLAN PROVIDES FIVE SPACES ON SITE, INCLUDING 180 A DA, UM, STALL, AND THE REMAINING TWO WILL BE SATISFIED THROUGH A SHARED PARKING AGREEMENT WITH BILL MILLERS.
TWO BICYCLE SPACES ARE ALSO PROVIDED, WHICH EXCEEDS THE UDC MINIMUM REQUIREMENT.
THE APPLICANT SUBMITTED A PEAK HOUR TRAFFIC GENERATION WORKSHEET SHOWING 50 7:00 PM TRIPS, WHICH DOES NOT MEET THE THRESHOLD TO REQUIRE A FULL TRAFFIC IMPACT ANALYSIS.
IN ADDITION TO THE LID OR LOW IMPACT DEVELOPMENT FEATURE AND THE LANDSCAPING, THE APPLICANT HAS ALSO SUBMITTED A PHOTOMETRIC ANALYSIS PLAN SHOWING COMPLIANCE WITH DARK SKY REGULATIONS.
ALL UTILITIES HERE ARE AVAILABLE AT THE SITE AND, UH, HAVE SUFFICIENT CAPACITY ONTO OUR KEY FINDINGS AND ANALYSIS.
THE COMPREHENSIVE PLAN, UM, COMPATIBILITY, IT'S CONSISTENT WITH THE AUTO ORIENTED COMMERCIAL DESIGNATION.
UH, THE PLAN IS ALSO CONSISTENT WITH C3 ZONING SUBJECT TO THE APPROVAL OF THIS SUP.
UH, NOISE LIGHTING AND ACTIVITY LEVELS ARE CONSISTENT WITH ADJACENT COMMERCIAL USES IN TERMS OF ACCESS, CIRCULATION AND PARKING.
THE DRIVE-THROUGH STACKING DOES EXCEED UDC UDC SECTION FIVE DASH SEVEN'S MINIMUM STANDARDS REGARDING ENVIRONMENTAL CONSIDERATIONS.
THE OVERLAY IS, UM, IT'S ADDRESSED THROUGH THE LOW IMPACT DEVELOPMENT AND THE ZERO ESCAPING.
AND THEN THERE ARE, THERE IS ADEQUATE ACCESS, CIRCULATION AND PARKING WITH THE SHARED AGREEMENT.
AND SO, IN SUMMARY, STAFF FINDS THAT THE REQUEST IS CONSISTENT WITH A COMPREHENSIVE PLAN COMPATIBLE WITH THE ZONING DISTRICT AND MEETS THE APPROVAL CRITERIA OUTLINED IN SECTION TWO DASH FIVE OF THE UDCA BURNING NEIGHBORHOOD DISCUSSION WAS HELD ON AUGUST 19 TO GATHER INPUT.
PUBLIC NOTICE WAS PROVIDED THROUGH MAILED LETTERS, NEWSPAPER POSTINGS, AND ONSITE SIGNAGE.
ONE COMMENT WAS RECEIVED IN OPPOSITION FROM WITHIN THE 500 FOOT RADIUS.
I DID PLACE THAT, UM, ON A FEW OF YOUR DESKS SO YOU CAN SEE THE RESPONSE.
AND STAFF RECOMMENDS THAT THE PLANNING AND ZONING COMMISSION HOLD A PUBLIC HEARING AND DETERMINE IF THE REQUEST MEETS THE STANDARDS OF THE UDC OUTLINING SPECIAL USE PERMITS.
IF THE COMMISSION CHOOSES TO RECOMMEND APPROVAL, STAFF RECOMMENDS THE INCLUSION OF THE FOLLOWING FOUR CONDITIONS.

THE PROPOSED USE SHALL CONFORM TO THE NARRATIVE AND SITE PLAN DATES STAMPED SEPTEMBER 24TH, 2025.THE FINAL DESIGN AND INSTALLATION OF THE PROPOSED BIO RETENTION LID FEATURE SHALL BE SUBJECT TO STAFF APPROVAL TO ENSURE COMPLIANCE WITH UDC.

IT'S ACTUALLY A PROJECT WE SUBMITTED TO THE MPO, UH, THAT WOULD GO CASCADE CAVERNS FROM THE FRONTAGE ROAD AND FURTHER DOWN.
UH, WE'VE BEEN STUDYING THAT INTERSECTION QUITE A BIT.
THAT PROJECT HAS BEEN KIND OF DELAYED AT THIS TIME AND IT'S GONNA TAKE A WHILE.
IT HAS LAND ACQUISITION AND OTHER, AND IT'S A FEDERALLY FUNDED PROJECT, SO THERE'S A LOT OF FEDERAL THINGS THAT WE HAVE TO GO THROUGH IN THE PROCESS.
UM, SO WE'RE STILL WORKING THROUGH THAT, BUT THAT'S SEVERAL YEARS OUT.
UM, WE HAVE BEEN WORKING WITH OTHER DEVELOPMENTS IN THAT GENERAL AREA FOR THE CASCADE.
AND I'M ASSUMING THE CASCADE SCENIC INTERSECTION IS WHAT YOU'RE REALLY SPECIFICALLY TALKING ABOUT.
UM, WE HAVE BEEN LOOKING WITH SOME OTHER DEVELOPERS AT POTENTIAL MITIGATION IMPROVEMENTS.
AGAIN, WHEN EVERY DEVELOPMENT TURNS IN THEIR TRAFFIC IMPACT STUDY, THAT'S SOMETHING WE LOOK AT FOR THAT PARTICULAR INTERSECTION.
AND THERE ARE SOME IMPROVEMENTS THAT CAN BE DONE OVER TIME WITH JUST A SIMPLE TURN LANE.
UM, AND THAT INTERSECTION IS VERY, VERY CLOSE TO MEETING THE WARRANTS OF BEING SIGNALED.
AND SO IT'S SOMETHING THAT CAN BE DONE AT A, AT A LATER DATE.
MR. CARROLL, I KNOW THE, UM, IN FACT, AS I DROVE BY THIS PARTICULAR, UH, PROJECT THIS EVENING OR PROPOSED SITE, IT LOOKED LIKE THE GENEVA DRIVEWAY WAS NEARING COMPLETION, WHICH WOULD ALSO ADD QUITE A BIT OF RELIEF.
THAT'S SOMETHING WE WORKED WITH GENEVA, UM, LETTING THEM BUILD THEIR, THEIR DRIVEWAY.
AND THAT'S SOMETHING THAT WE'RE TARGETING THAT IT WILL REDUCE TRAFFIC BECAUSE THE MAJORITY OF THAT GENEVA TRAFFIC WILL GO THROUGH THEIR NEW DRIVEWAY OFF I 10 RATHER THAN GOING THROUGH CASCADE CAVERNS.

WE HAD A COUPLE, UH, REALLY GREAT INTERNS THAT HAVE WORKED WITH US OVER THE LAST TWO YEARS AND KIND OF TAG TEAM ON THAT PROJECT.
SO ESSENTIALLY A, A GOOGLE EARTH STREET VIEW INVENTORY OF ALL LIGHTING TYPES WITHIN THE CITY, WHICH WILL HELP US WHEN WE GO TO LOOK TO RETROFIT LIGHTS AND KIND OF BECOME MORE DARK SKY COMPLIANT AS A COMMUNITY.
WE CAN PRIORITIZE THOSE RETROFIT PROJECTS BASED ON THAT OUTDOOR LIGHTING INVENTORY.
UH, WE'RE GONNA START A SKY, UH, SKY QUALITY MONITORING PROGRAM.
UH, THERE'S SOME AUTOMATED SKY QUALITY MONITORS WE'RE GONNA INSTALL ONE OUT AT BERNIE CITY LAKE.
KIND OF LOOK AT CHANGES IN LIGHT POLLUTION OVER TIME.
THESE, ALL THESE BULLET POINTED ITEMS HERE ARE PART OF THE APPLICATION REQUIREMENTS TO YOU SUBMIT TO, UH, THE INTERNATIONAL DARK SKY ASSOCIATION TO OBTAIN THIS DESIGNATION.
UM, OUR KENDALL COUNTY FRIENDS OF THE NIGHT SKY GROUP HAS DONE A GREAT JOB OF KIND OF TAKING THE OUTREACH AND EDUCATION COMPONENT OF THIS.
SO THEY HOST STAR PARTIES AND THERE'S EMAIL BLAST TWICE A WEEK ABOUT OUTDOOR LIGHTING AND COOL, UM, YOU KNOW, ECOTOURISM AND ASTROLOGY, UH, UM, NIGHT SKY VIEWING OPPORTUNITIES IS, IS THEY DO A REALLY GREAT JOB OF THAT.
CURRENTLY SOLICITING LETTERS OR GETTING LETTERS TO SUPPORT FROM THE COMMUNITY.
UM, UH, THE COUNTY, SOME OF OUR CONSERVATION ORGANIZATIONS, SOME OTHER BUILDERS AND DEVELOPERS HAVE AGREED TO PROVIDE A LETTER OF SUPPORT TO US TO SEEK THIS DESIGNATION.
AND THEN THE COUNCIL RESOLUTION THAT WE PASSED IN 2021, UH, WHERE COUNCIL GAVE US THE, THE BLESSING TO GO AHEAD AND KIND OF PURSUE THIS APPLICATION.
IT'S A MULTI-YEAR PROCESS TO GET THIS DESIGNATION, YOU HAVE TO SHOW THAT YOU'RE ACTIVELY WORKING, UH, WITH THE COMMUNITY AND TRYING TO OBTAIN A LOT OF THESE ITEMS HERE, INCLUDING ENFORCEMENT OF A DARK SKY ORDINANCE.
AS YOU CAN SEE AT THE BOTTOM, A LOT OF OUR SURROUNDING COMMUNITIES ARE ALREADY WORKING ON THIS, UH, BLANCO DRIVEN SPRINGS, FREDERICKSBURG, HORSESHOE BAY, CAPE WEBERLEY, THEY'VE ALL ACTUALLY ACHIEVED THIS INTERNATIONAL DARK SKY COMMUNITY DESIGNATION AND, UH, BULVERDE KENDALL AND, UH, CITY OF BULVERDE.
AND THEN KENDALL AND COUNTIES HAVE THEIR APPLICATION IN PROGRESS RIGHT NOW.
SO IT'S, IT'S REALLY NICE TO BE KIND OF RUNNING SIMULTANEOUS WITH KENDALL COUNTY, ESPECIALLY WITH OUR COUNT BOLUS, DARK SKY, UH, REQUIREMENTS TO, YOU KNOW, HELP FACILITATE THE NIGHTTIME TRAINING OPERATIONS DOWN ON COUNT BOAS.
THESE ARE ALL THINGS THAT WE'RE WORKING KIND OF JOINTLY TOGETHER TO BECOME DESIGNATED AS, UH, THIS INTERNATIONAL DARK SKY COMMUNITY.

ABSOLUTELY.UM, THE ONLY MECHANISM THAT WE HAVE TO KIND OF, UM, ENCOURAGE THAT THROUGH A PERMITTING PROCESS WOULD BE IF THEY APPLIED FOR SOME TYPE OF REMODEL PERMIT.
AT THAT POINT, WE WOULD ASK THEM TO BRING THEIR LIGHTING INTO COMPLIANCE WITH CURRENT STANDARDS.
OR IF THERE WAS SOME TYPE OF DAMAGE THAT OCCURRED TO THE PROPERTY WHERE GREATER THAN 50% OF THE APPRAISED VALUE OF THE PROPERTY WAS LOST AND THEY HAD TO REBUILD AT THAT POINT, WE WOULD ASK THEM TO RETROFIT THEIR PROJECT TO COME UP TO OUR DARK SKY LIGHTING STANDARDS.
UM, WE'VE HAD, WE'VE HAD, UM, SEVERAL PROJECTS RECENTLY WITH JUST REMODEL, REMODELING PERMITS WHERE, UH, FLOODLIGHTS ARE ACTUALLY A, A, A NON-CONFORMING LIGHTING TYPE.
SO JUST FOR OUTWARD SHINING FLOODLIGHTS ON THE CORNER OF YOUR HOUSE LIKE THAT WE ALL GREW UP WITH LIKE, LIKE THAT I RETROFITTED AT MY HOUSE.
THOSE ARE A NONCOMPLIANT LIGHTING TYPE UNDER THE ORDINANCE NOW.
SO IF IT'S A COMMERCIAL PROJECT THAT HAS THOSE, WE ASK THEM TO PUT A, UH, DOWNWARD LID, WALL-MOUNTED LIGHT AND TO PROVIDE THAT EXTERIOR LIGHTING FOR THE, UH, REPLACEMENT OF THE FLOODLIGHT.

WHEN, WHEN, UH, DURING SOME OF THE PUBLIC HEARINGS FOR HONDA, UH, WE HAD SOME NEIGHBORS THAT WERE COMPLAINING ABOUT THE LIGHTS AT THE NISSAN STORE.
ARE THOSE DARK SKY COMPLIANT? NO, SIR.
UH, THE NISSAN PROJECT'S A GREAT EXAMPLE OF BEING INSTALLED.
PRIOR TO OUR, OUR ORDINANCE REQUIREMENTS, THEY ACTUALLY HAD A, A LOT OF OFFSITE LIGHT TRESPASS ONTO THE HONDA SITE.
SO WE WERE ABLE TO KIND OF WORK WITH THE HONDA TO NOT BE AS STRICT ON THAT SIDE OF THE PROPERTY.
'CAUSE IT WAS HARD TO DISTINGUISH BETWEEN WHAT WAS COMING OFF OF THE EXISTING HONDA SITE VERSUS THE PROPOSED LIGHTING, I MEAN, OFF THE NISSAN SITE VERSUS THE PROPOSED LIGHTING ON THE HONDA SITE.
UM, THAT'S, UH, THAT SITE'S OVER LIT, YOU KNOW, BASED ON OUR ORDINANCE TODAY, WE WOULD'VE DIALED BACK AND RELOCATED AND READJUSTED AND SHIELDED A LOT OF THOSE LIGHTS ON THE, ON THE NISSAN PROJECT.
DO YOU KNOW OF ANY OTHER MUNICIPALITIES THAT ARE OFFERING FINANCIAL INCENTIVES TO BUSINESSES TO, UH, RETROFIT OR CONVERT TO DARK SKIES? UM, THE, SOME OF OUR, I THINK AUSTIN DOES SOME OF THE LARGER CITIES IN THE STATE.
DO I, I DON'T KNOW OF ANY OF THESE SMALLER MUNICIPALITIES HERE THAT LIKE, THAT HAVE ACHIEVED THIS, UM, DARK SKY DESIGNATION.
I DON'T KNOW IF THEY HAVE AN AN INCENTIVE PROGRAM FOR RETROFITS, BUT IT IS SOMETHING WHEN YOU LOOK INTO THE LITERATURE OF HOW A COMMUNITY STARTS AND WORKS TO OBTAIN THIS DESIGNATION AND REALLY BECOME A MORE DARK SKY FRIENDLY COMMUNITY.
THERE IS LANGUAGE IN THERE ABOUT HOW YOU CAN START THAT TYPE OF INCENTIVE PROGRAM TO, TO DO A RETROFIT AND CHANGE OUT LIGHTS.
YEAH, BECAUSE I WOULD THINK ALL IT WOULD TAKE IS ONE OR TWO BAD APPLES OR NON-COMPLIANT BUSINESSES TO REALLY THROW A MONKEY WRENCH IN ALL THIS.
IT CAN, IT'S INTERESTING TO FLY OVER BERNIE COMING INTO TO THE AIRPORT AND LOOK DOWN AND YOU CAN REALLY SEE, UM, HOW MOST OF THE TOWN REALLY IS, IS IS PRETTY DARK.
AND THEN, YOU KNOW, YOU CERTAINLY CATCH THE I 35 CORRIDOR THERE AND YOU CAN SEE SOME OF THE PROBABLY OVER LIT PROJECTS AND MOST OF THOSE ARE AUTO SALES.

UM, AND THE REASON I ASK IS, 'CAUSE I THINK BUILDERS AND DEVELOPERS PROBABLY DO A REALLY GOOD JOB OF COMPLYING WITH THIS, BUT THEN THE HOMEOWNER MOVES IN AND INSTALLS A COUPLE OF 7, 7 47 LANDING LIGHTS.

IT'S, AND, AND THAT'S ONE THING THAT'S KIND OF HARD TO POLICE, YOU KNOW, ON A, SOMEONE THAT INSTALLS A DIY LIGHTING KIT, UH, WHEN WE DO RECEIVE COMPLAINTS, CODE ENFORCEMENT WILL REACH OUT TO THAT PROPERTY OWNER.
WE'VE HAD THOSE WHERE THERE'S JUST SOME PRETTY EGREGIOUS OFFSITE LIGHT TRESPASS WHERE, YOU KNOW, SOMEONE HAD A, YOU KNOW, NIGHT STAR BACKYARD AND THE NEIGHBOR JUST PUT SOME OF THOSE BIG SQUARE HALOGEN LIGHTS ARE SHINING OFF, UH, ONTO THE PROPERTY.
AND SO CODE ENFORCEMENT HAS TO CONTACT THEM AND REQUEST A, A SWAP OUT OF THOSE FIXTURES TO A DARK SKY COMPLIANT FIXTURE.
