THE APPLICANT IS RECRE IS REQUESTING VARIANCES TO UDC SECTION NINE DASH FIVE A FIVE, AND APPENDIX DA TWO.

SECOND, TO ALLOW ASSIGNED BACKGROUND THAT IS NOT DARKER THAN THE LETTERS, NUMBERS, OR DESIGN.
AND THIRD, TO ALLOW SIGN ILLUMINATION WITH A CORRELATED COLOR TEMPERATURE OF APPROXIMATELY 7,100 K KELVIN, WHERE THE MAXIMUM PERMITTED IS 2,700 KELVIN.
THIS SLIDE SHOWS THE PROPOSED SIGN LOCATION.
THE APPLICANT IS PROPOSING A WALL SIGN ON THE NORTH SIDE ELEVATION OF THE BUILDING FACING NORTH MAIN STREET.
THE SIGN WOULD BE MOUNTED ON THE SIDEWALL OF THE EXISTING COMMERCIAL BUILDING AND WOULD SERVE THE O'REILLY AUTO PARTS TENANT SPACE.
THIS STREET VIEW SHOWS THE EXISTING COMMERCIAL SITE ALONG NORTH MAIN STREET AND THE GENERAL PLACEMENT OF THE PROPOSED WALL SIGN.
THE PROPOSED SIGN WOULD BE LOCATED ON THE SIDE ELEVATION OF THE BUILDING VISIBLE FROM NORTH MAIN STREET.
THE REQUEST BEFORE DESIGN REVIEW COMMITTEE TONIGHT IS NOT FOR THE LOCATION OF THE WALL SIGN, BUT FOR THE SIGN COLOR COMPOSITION AND ILLUMINATION STANDARDS.
THE PROPOSED SIGN IS AN INTERNALLY ILLUMINATED WALL SIGN CONSISTING OF THE O'REILLY CLOUD LOGO HERE, AND THEN AUTO PARTS AS CHANNEL LETTERS.
THE SIGN IS APPROXIMATELY SIX AND A QUARTER FEET TALL BY 26 AND A HALF FEET WIDE, WITH AN OVERALL SIGN AREA OF 165.63 SQUARE FEET BASED ON THE ENCOMPASS TRI, UM, THE ENCOMPASSED RECTANGLE

ALONG JUST THE, SO IT WOULDN'T BE THIS WHOLE AREA, IT WOULD JUST IF YOU DREW A RECTANGLE ACROSS THE ILLUMINATED PORTIONS.THAT'S HOW WE CALCULATE HOW MUCH WHITE SPACE IS FOR THE SIGN.
AND THE PROPOSED WHITE AREA IS 26.2% OF THE SIGN BASE.
THIS SLIDE SUMMARIZES THE APPLICABLE UDC STANDARDS AND THE REQUESTED VARIANCES UNDER UDC SECTION NINE DASH FIVE A FIVE WHITE OR SHADES OF WHITE ARE LIMITED TO 20% OF THE SIGN FACE.
UH, AGAIN, THE APPLICANT IS PROPOSING 26.2%.
UM, AND THAT SAME SECTION ALSO REQUIRES THAT SIGN BACKGROUNDS BE DARKER THAN THE LETTERS, NUMBERS OR DESIGN.
UM, AND THE PROPOSED SIGN DOES NOT MEET THESE STANDARDS, BUT ACTUALLY THAT ONE DOES.
THE BACKGROUND IS DARKER THAN THE LETTERS, BUT IT'S STILL REQUESTING THE VARIANCE TO THE 20% MAX WHITE ALLOWED ON THE SIGN.
AND THEN UNDER APPENDIX DA TWO, WHICH IS THE DARK SKY REGULATIONS SIGN ILLUMINATION IS LIMITED TO A MAXIMUM COLOR TEMPERATURE OF 2,700 K, WHICH YOU CAN SEE HERE IN THIS RED, UM, RECTANGLE.
THIS IS WHAT THE UDC MAX ALLOWS.
IT'S MORE OF A WARM WHITE COLOR.
AND WHAT THE APPLICANT IS PROPOSING IS THAT THE ILLUMINATION B 7,100 K, WHICH IS IN BETWEEN THESE TWO COLORS.
SO IT'S A COOL WHITE THAT THEY ARE REQUESTING.
UM, THE GRAPHIC ILLUSTRATES THAT IT'S WARMER AND THEN, UM, THEY'RE PROPOSING ON THE COOLER LIGHT RANGE.
THE REQUEST WAS REVIEWED AGAINST THE VARIANCE APPROVAL CRITERIA IN UDC SECTION TWO DASH 10 E FOUR C.
THESE ARE THE FIVE CRITERIA, AND THE FOLLOWING FINDINGS ARE FOR UNNECESSARY HARDSHIP.
LITERAL ENFORCEMENT DOES NOT APPEAR TO CREATE AN UN UNNECESSARY HARDSHIP OR PRACTICAL DIFFICULTY.
A COMPLIANT SIGN CAN BE INSTALLED AND THE REQUEST IS BASED ON THE APPLICANT'S PREFERRED CORPORATE SIGN DESIGN, COLOR COMPOSITION, AND THE LIGHTING SPECIFICATIONS FOR UNIQUE CHARACTERISTICS.
THE SITUATION IS NOT UNIQUE TO THE PROPERTY.
THIS IS AN EXISTING COMMERCIAL PROPERTY ALONG A MAJOR CORRIDOR, AND SIMILAR PROPERTIES ARE SUBJECT TO THE SAME SIGN.
STANDARDS FOR HARDSHIP, NOT SELF-IMPOSED.
THE REQUESTED DEVIATIONS RESULT FROM THE PROPOSED SIGN PACKAGE.

THE WALL-MOUNTED SIGN IS NOT EXPECTED TO PHYSICALLY OBSTRUCT ACCESS, BLOCK VISIBILITY, OR PREVENT ADJACENT PROPERTIES FROM CONTINUING PERMITTED USES.
AND FINALLY, FOR HARMONY WITH THE UDC, THE REQUEST IS NOT IN HARMONY WITH THE INTENT OF THE ADOPTED SIGN AND DARK SKY STANDARDS.
THE VARIANCES WOULD ALLOW THREE DEVIATIONS WITHIN THE ENTRANCE CORRIDOR OVERLAY DISTRICT BASED ON THE REQUIREMENTS OF UDC SECTION TWO DASH 10 E FOUR C.
THE DESIGN REVIEW COMMITTEE SHOULD DETERMINE WHETHER THE REQUEST MEETS THE CRITERIA FOR THE VARIANCES.
THE REQUESTS MAY BE APPROVED, APPROVED WITH CONDITIONS DENIED OR DENIED IN PART.

IT'S LITERALLY, UM, IF THIS IS THE SIDE THEN PERPENDICULARS WHERE THE FRONT, THE FRONT DOES FACE, UM, INTO THE PROPERTY BOUNDARY.
IT FACES THE PARKING LOT, LIKE, YOU KNOW, WHERE DOLLAR TREE IS.
AND WHERE HARBOR FREIGHT WITH THIS, UM, I THINK REQUIRES ADDITIONAL CONSIDERATION AS IT DOES FACE, UM, THE MAIN NORTH MAIN STREET CORRIDOR.
SO ANY LIGHT T TRACE TRESPASS OR THE EFFECTS, YOU KNOW, IT'S A DIFFERENT EFFECT BECAUSE THE LOCATION IS DIFFERENT AND IT'S MORE VISIBLE FROM THE PUBLIC.
I JUST CLARIFYING, WE WEREN'T TALKING ABOUT THE OTHER O'REILLY IN TOWN.
NOW I UNDERSTAND WHERE YOUR QUESTION CAME FROM.
UM, ADDITIONALLY, I WANTED TO ADD THAT THESE REQUIREMENTS APPLY ACROSS THE CITY OF BERNIE AND OUR ETJ.
UH, IT DOES NOT MATTER WHAT ZONING DISTRICT A PROPERTY IS IN.
THIS IS THE SIGN STANDARDS AND THEY SUPPORT THE CITY'S INITIATIVE TO BE A DARK SKY CITY.
THIS IS A VERY IMPORTANT, IMPORTANT COMPONENT OF THAT.
SO IS IT POSSIBLE TO STILL GET THE SAME COLOR WHITE BUT NOT BE AS BRIGHT? NO, THAT'S A GREAT QUESTION.
UM, IT, IT IS OFTEN CONFUSING.
THE BRIGHTNESS IS A DIFFERENT, UM, STANDARD THAT'S MEASURED DIFFERENTLY THAN THE COLOR TEMPERATURE.
SO YOU CAN HAVE A VERY BRIGHT 2,700 K THAT LEANS MORE WARM OR A DIMMER 7,100 K.
BUT WHAT THE STANDARD IS, WE DON'T HAVE A STANDARD FOR HOW BRIGHT THE LIGHT IS.
JUST THAT IT CAN'T HAVE ANY LIGHT TRESPASS OVER THE PROPERTY LINE.
UM, BUT WHAT THIS STANDARD IS, IS PURELY THE, THE COLOR TEMPERATURE OF IT RATHER THAN THE BRIGHTNESS.
AND AGAIN, I WANNA MENTION, BECAUSE THIS DOES APPLY ACROSS THE CITY, WE'VE HAD MANY DIFFERENT NATIONAL AND INTERNATIONAL BRANDS THAT DID HAVE TO MODIFY THEIR SIGNS TO MEET THIS REQUIREMENT.
SO I MEAN THIS, IF THIS IS DENIED, COULD WE PROPOSE A SMALLER SIGN, UH, TO MATCH THIS FRONT SET? THE FRONT SET IS A LITTLE BIT SMALLER JUST TO KIND OF AT LEAST ELIMINATE THE 20% WHITE WOULD BE, I THINK, UH, I THINK I TOLD YOU IT WAS LIKE 16 OR 19% WHITE VERSUS THE 26 ON THIS ONE.
SO, SO IT'D BE MORE IMPORTANT TO YOU TO MATCH THE COLOR THAN IT WOULD BE FOR THE SIZE.
I MEAN, I'M JUST GONNA TRY TO GET ANYTHING.
AT LEAST SOMETHING OF A WIDE, WHETHER IT'S THE, THE 7,100 K OR HAVE THEIR SIGN WHERE THEY DON'T HAVE TO DEER TAPE FROM THE, UH, THE WHITE COLOR FACE.
SO A LITTLE BIT SMALLER SIGN WOULD PROBABLY CREATE LESS BRIGHTNESS IF HE KEPT THE SAME COLOR TONE, BUT SMALLER.
IT WOULD BE LESS, LESS BRIGHTNESS, BUT IT, THE 27 K WOULD DEFINITELY MAKE IT A LOT DIMMER.
